But in 2014, OTF Didi allegedly slid on shields with two other BDs and killed a dude from the set named Travis.
D.D. got booked on a murder case and had to sit down for a few years, and that's when he got into it with Lil Sean from PBG.
Some PBG dudes were allegedly cool with some BDs in Oblock and other hoods, but PBG was also cool with some of their ops.
They weren't really beefing, but something went down with Lil Sean and,
an OTF DD that sparked the fight behind bars.
Little Sean was tight with a rapper from PBG named Young Pappy.
Young Pappy was one of the hottest up-and-coming drill rappers in Chicago at the time,
and everyone thought he was going to be the next to blow up.

when one or two shooters snuck up behind him and shot young Pappy right in the back.
Pappy ended up getting killed,
and that's when little Sean allegedly started crashing out.
Rumors said that he killed a dude named Von LaFlair while he was working at a car wash.
And some people think he pulled the trigger on two dudes from Loak City named AJ and V-12.
Lil Sean only got booked for one murder, but he was also listed in a police report after AJ from Loak City got killed.
OTF, Didi and Lil Sean were both allegedly putting major pressure on their ops,
and then they got into a fight when they ran into each other inside the Cook County jail.
We don't know what sparked it, but Didi and Lil Sean made it clear to the cops that they weren't going to talk about the situation.
Didi held her down while he was locked up and got out on bond in 2019.
But what happened next is one of the craziest situations that ever went down in Chicago.
Little Dirk put up 90K for OTF Didi to come home on bond,
but his homies weren't the only ones waiting for him and got out of jail.
Right after Didi got out, the ops set him up and put him through something brutal.
The ops held guns to Didi's head, cut off his dress,
and then made him eat out a woman who was on her period,
but they recorded the whole thing and laughed at him.

And that testimony by those guys, even if they're lying, is evidence.
So a judge wouldn't throw out, you know, if all the cooperatives got up there and been like,

And I think that, you know, any good defense counsel, and he's got great defense counsel, any good defense counsel is going to bring this up on Tuesday.
And, you know, it's just, I've never seen anything like it.
I've really, and I've had a lot of cases, I've never seen a cooperating witness go on Twitter and start making statements like that.
And on one of them, it appears that he's almost threatening other potential witnesses or witnesses that were going to appear or appeared.
I've just never seen anything so stupid.
I mean, it doesn't shock me.
I don't think the guy's a genius.

From some people who reached out, they said there was a possibility that he might be down to do a jailhouse interview with me.
And I was thinking, I was like, you know what?

when it comes to like what he said.
So, you know, he starts off by basically saying,
hey, listen, you know, I'm not scared of anyone.
I'm not ducking nothing.
But I do want to say this, fuck, dirt.
And that was like, that,
basically sets his intent where I'm wondering if now as a defense attorney,
I could possibly use this to be like,
hey, listen, this guy who we have all proven,
not only is he a killer himself,
this guy's on trustworthy,
he goes on Instagram and basically says his motive was to get back at Dirk, right?
It's even better than that because he says the jealousy angle of saying
that the only reason he was in charge
is because he has money.
Like it really shows
you know, a distinct bias.
He's already off the stand.
They've already done closings.
And now he makes this statement.
It just really opens up a can of worms
that I'm sure the government is not going to be happy with.
Because we're going to have to see how the judge deals with it.
Because, I mean, you can't reopen.
Everyone's, you know, everyone's, we're ready
to close. I don't know
if he would let the defense
reopen their case
before closings.
And I just, you know,
the state rested, defense rested, it'd be
unusual to do it.
So let me ask you this.
So there's one
place in this whole little soliloquy
that he writes up that
counters what he did say
on the stand. Some of it affirms it, but
there's one thing that does.
There was a part where it was clear that

or actually was Steele,
still clearly,

and probably was there
in contact with,

his baby mama and,

these women he was dealing with.

and they say to him,
they say,

I never did any,

When you read this message,

You know, so at that point it's like, how do you play this?
What do you do?
It's a very, this is a very tough situation for the prosecutor.
It's tough for the judge as well.
I mean, I have seen judges allow, especially in federal court,
I had a case where the federal prosecutor forgot to ID my guy.
You know, so like I moved.
I moved to.
to dismiss the case because the federal prosecutor, you know, at the time they rested,
they forgot to ID my client and the judge allowed them to reopen their case to make the identification.
I've never seen, you know, a situation like this where the judge would allow the defense to reopen their case.
It can happen.
and then put him back on the stand.
But then he's your witness technically.
It's just, and then, you know, the judge would have to allow you to treat him as a hostile witness and cross him on this one thing.
But I don't know if the defense would want to do that.
It's really just, you know, a really sticky situation where, you know, it wasn't necessary but for, you know, the government not being able to do that.
to control their own guy, which I don't think anyone can control that guy.
So it doesn't help their case.
You know, it certainly doesn't help their case.
I think it makes it a lot worse.
And it just adds another layer of shit.
You know, it's like once those layers start building up and then you have like appellate issues,
you have just like, you know, it looks, it looks ridiculous in front of a jury if you have to
reopen because this guy's tweeting from prison.
It's just a bad, bad situation.
It really is.
Let me ask, okay.
So for the government, by the way, for the government.
It's not bad for the defense.
Okay.
This is certainly, it's almost like a gift for the defense, to be honest with you,
because it's just another layer of, you know, errors that are happening that can raise
issues on appeal or can raise issues, you know, to put them back on the stand.

So do you see any, you know, obviously I'm pretty sure they might.
try to even motion for mistrial at the beginning of the Tuesday,
maybe something even submitted over the weekend in terms of that mentions this.
Do you see that being a possibility at all based on this?
I think the judge will try and avoid it any way you can.
Really experienced federal judges can figure out ways to either,
A, screw you and not be appealable or B, cover their ass.
is when it comes to situations like this.
If I'm the judge and I know about this now,
I'm going to research it.
I mean, in a bare minimum,
you know,
if they move from his trial,
he denies it,
he probably would have to give the option of reopening
or giving an instruction or talking to the jury.
And I mean,
for sure,
they're going to ask the jury,
you know,
we had a long weekend.
Did anyone see anything?
Did anyone hear anything?
Have you talked to anybody?
I mean,
certainly that's going to,
That's definitely coming.
I don't see them avoiding, you know, asking a jury that.
And that's kind of commonplace anyways over a long weekend.
But I think that there's a way that the judge can probably mitigate the situation.
I just don't know if that's going to happen.
I don't know if, I don't think he's going to grant a mistrial based on this.
I just don't, I just don't think so.
I mean, you have to move for it because for appellate purposes, you have to raise.

But the judge could allow them to reopen because closings haven't been done and put him on
the stand for the purposes of addressing these issues.
That would be something that is a possibility.
I just don't know.
You know, I haven't been in a situation where a cooperator is stupid enough to go on
Twitter.
This is the first.
For me, at least.
I don't know.
Maybe it's happened before.
I don't know of any, you know, my profile case where a cooperating witness before the case is over went on Twitter and started saying, you know, ridiculous things or possibly threatening a witness.
It's just not a smart move.
Absolutely absurd.
Now, I want to pick your brain on this because I was trying to do my, I'm doing my internet lawyer thing trying to like, you know, I was just reading the, I'm going to be your sponsor.

They're saying,

because the judge might rule on this Rule 29 motion
that his defense put in.
And it targets two different things.
It targets insufficient evidence based on the stalking charge claiming if the person doesn't know that they're being stalked.
It's not real stalking if you interpret it that way.
And then second of all, the murder for hire thing that says there has to be something offered either money or something of pecuniary value.
And if they didn't prove that dirt like specifically offered something.
thing, even though there's a bunch of, you know, they've heard from middlemen who said he did,
but if he didn't do it himself, do you also get a Rule 29, and there's a directed,
Bert on that, is an acquittal, basically.

So I think, yeah, procedurally, Rule 29s are made.
I mean, that's just what we do.
But the likelihood that it gets granted is slim.
It may get granted on the stalking.
I think the stalking is a really interesting.
argument and a good argument. I don't know if the judge would take it out of the jury's hands on the
murder for hire. I mean, I heard the testimony. I do think it's weak, but you're looking at the
light most favorable to the government. And if you're looking at the light most favorable to the
government, you're saying, is there enough there, you know, to get past this burden? And it's not
beyond a reasonable doubt, you know. So I think there's enough there, probably.
to give it to the jury on that charge.
The stalking charge is an interesting one.
I think that's that I could see the judge getting rid of a count, you know, for the, for the stocking and just going forward with the other two counts with Dirk.
I think he has two other counts.
Wait, wait, hold on.
That are particular to him.
Let me ask you about the stalking charge particularly, because I was always wondering what the government was thinking with this.
So they're all intertwined.
That's why I'm worried.
That's what I'm trying to figure out how they would do that.
Remember, we had this discussion where I don't know if a jury could find him guilty of the stalking
and not find him guilty of the murder for hire or find him guilty of murder or higher,
but not find him guilty of the stalking.
I think they're all intertwined.
And I think that was also kind of the argument, there was a secondary argument for either the Rule 29 or one of the motions they filed,
where they were essentially saying,
hey listen, you know, this stalking charge, it essentially is enveloped into the murder for hire and the
attempted murder.
You know, all these things are all related.
So it's just kind of like an extra charge that really shouldn't be there because it should be swept up into the other two charges.
It's an interesting argument.
I don't know if the judge is going to buy that portion of it.
But that's what makes it difficult, right?
So if the judge says, you know, I don't know, these are so intertwined.
I'm not sure if I can unwind it and just say, okay, yeah, I'm going to get rid of the aggravated stalking.
I like their argument, though.
Like, you know, nobody knows that it's stalking.
If they don't know you're stalking them, what is the aggravated stalking?
It's an interesting argument.
I don't know if it'll be successful or not.
But there is some case law that if you interpret it a certain way, you could get there.
And listen, you know, all his attorneys are very good at, or they're very good at making these kind of arguments.
So we'll say.

Like if they go for second degree murder and if they can't catch you on that, they're like, you know, we'll get you on the lesser charge.

in charge. Obviously, I mean, the other charges are more serious, but, you know, if already you're
kind of like laying the groundwork for, hey, maybe it's not that easily provable that, you know,
this guy said, he offered something of value, whatever, or any of the other things.
And it's not easily, I'm not saying that it's easily, yeah, I'm not saying it's easily
provable. It's just that, you know, on the rule 29, it's very difficult to get ruled 29.
because essentially it comes down to like you're missing a whole element and I don't know if they're I mean completely missing like there's not a shred of evidence for that element and because they always look like like I said they look in the light most favorable to the government they give them every kind of you know tip of the hat they can give them so it's very difficult especially in federal court it's very difficult to get a rule 29 because they at least put on a prima facia that hey there's a there's a there's a
this element is there.
It might not be the strongest, but it's there.
That's why Rule 29 are very difficult.
You really have to come down to like, there's just, the Rule 29 is just like, it's not
there.
It's like, so my case where they failed to ID, I mean, obviously you got to ID a defendant.
So my Rule 29 is like, hey, listen, there's no identification.
You can, you know, you can attack jurisdiction on Rule 29.
You can attack identification on Rule 29.
So like online, there was just no identification.
And the likelihood that ever happens in a federal case?
No, I had three, there was, there was three co-defendants.
I was the third of the three.
And it was such a, it was a shitty case to begin with.
It was an extortion case.
And the people that took the stand, no one ever just said, like, that's the guy.
And at the end of the day, you know, when I made the rule 29, it was really embarrassing to the government,
because it's like, no, when you're at the Fed level, you don't fail to ID the defendant.
That's like Mr. Meanor Court, you know, like, you know, you're in a D you're in a DUI trial,
you're a 28 year old kid, you forget to do jurisdiction or you forget to do ID.
Like, you know, every young attorney that ever tried a case when they're like right out of,
fresh out of law school, they have a checklist, you know, like, oh, I have to ID the defendant,
and I have to do this.
So, you know, like, it's embarrassing.
and it was embarrassing, but ultimately the judge allowed him to reopen and put someone on to identify the defendant.
So, you know, in this case, the judge has some ways around it, but it really does shitty up the waters for the prosecutor.
I'm sure they're not happy this weekend.
I'm sure they were enjoying their Sunday barbecue and then they got this.
And they're probably not enjoying.

happens and that's what I always tell everybody like people tell me this guy's cooked that guy's
cooked you know how many times I've had cases where they're like oh that guy's totally
fucked and like you just don't know until you know like until the bullets start flying no pun intended
but until the bullets start flying,
you don't know who's going to be the hero,
who's going to run for the hills,
who's going to show up to be at your side,

So when you are at a trial situation,
anything can happen.
Witnesses don't show up.
A witness takes the stand that it's, you know,

You don't know what kind of jurors you're.
you're going to get. You don't know what the judge is going to rule on on, you know, 30% of the

are going to be left out. It's just you don't know. So like when people say to me, you know,
what are my odds at, you know, trial and they say this all the time. Every defense attorney gets
this. What are my odds? And I say, like, listen, it depends on a lot of different things.
At the point you're ready to go to trial, it depends on a lot of things. You know, the jury walks in,
you start looking at the jury panel and you're trying to decide like just from looks who looks right
who doesn't look right you know who's got tattoos who doesn't have tattoos why is that guy wearing a hat
this guy's wearing a navy hat this guy's wearing something else all those things immediately go into it
and if you're not a litigator if you're not a trial attorney you don't know those things you know
these guys are just random guys commenting you on on uh on the internet
Like they don't know what goes into trials and how trials go.
So they're like, oh, this one thing was amazing today.
And I don't know if they just say it because of clicks.
But like, I'll look at it and be like, that wasn't that amazing.
Like that was okay.
Like, you know, that was good for the defense.
It wasn't a smoking gun, but it was good.
Or if it was good for the prosecutor, but it wasn't like, okay, the case is over.
You just don't know until you know.
And this is a tough case because, I mean, there's so many ups and downs in this case.
and this guy did a good cross-examination.
This guy didn't, you know, I'm watching all these commenters.

The most important thing is when you're picking a jury and when you're, you're arguing over
jury instructions, those are like such important things for trial.
People, some inexperienced lawyers don't think jury instructions, you know, can be changed
in any way or in a way that is very, very important to the defense.
But like, you can win a case during your argument for jury instructions.
You can win a case the way you pick a jury.
Like, it's just, that's just the way that it is.
And in this case, they're doing a really good job of really going to town on the jury
instructions and making sure that the jury instructions are properly laid out,
adding the ones that they feel like they had to add.
And if you notice, like, when they filed, like, what ones they agree to and what ones
they didn't, they didn't agree to the majority of those.
Like, you know, the first, I don't know, the first 20 instructions are all common instructions, right?
What the burden of proof is and what you're supposed to do and things like, that's all bullshit.
When you get down to the nitty gritty and you start getting into real instructions on like what elements need to be met and how those elements need to be met.
Right.
What evidence can be considered.
Those are the instructions when you win or lose a case.
And like I said, they didn't, you know, these guys are just.
experienced guys, they do a nice job. It's, it's, it's, that's where you know, you can make or break a
case. So, you know, this case isn't over by any stretch in the mean. Like, people are like,
oh my God, he's cooked. It's not cooked. It's like, you just don't know. You just really don't know.
I've had a million people tell me O.J. Simpson was going to be found guilty. I thought as soon as
they put on that glove, I mean, you're younger than I. I don't know if you were, if you were
around when watching the O.J. Simpson's like, I was in law school. Okay. You were a law school. I was a

He's going to be found guilty.

And people were like telling me like, you're still in law school.
You're telling me this experienced prosecutor so stupid because he did that.
I said, yes, he's so fucking stupid.
Like, how did he expect a glove that's been soaked in blood and it's been, you know, in a bag?
How did he expect that to fit on a guy's hand?
It's a leather glove.
It's going to shrink.
There's no way it's going to fit on his hand.
And, like, as soon as he did that, I was just like, this Johnny Cochran is going to pull this off.
And then, you know, the closings were legendary.
So, you know, I generally can see it coming.
This one is a more difficult case because there was ups and downs.
There was no smoking gun for either side.
And it's just one of those things that it's going to come down to.
Is it a good jury?
Did they listen?
Do they believe who was on the stand and how they testified?
And I think, you know, listen, I think the defense did a really good job.
And I don't think the prosecutors did a bad job.
They worked with what they had.
And, you know, I'm usually very critical of the government all the time.
But in this case, you know, they put on their witnesses.
they put on what they had.
I didn't see them make any huge mistakes
where I'd be like, wow, that really fucked the case up.
So it's a tough one to call.
But I think they, I wouldn't be shocked by a not guilty.
Let me put it that way.
It wouldn't be like, oh, my God, I didn't see it coming.
But, you know, we'll have to say.

It's tough.
Listen, federal cases are tough, bro.
Like, I mean, you know, and when people go,
oh, they have a 98% conviction rate.
It's also because 95% of the people take pleas that they have,
and that goes to their conviction rate.
So only like 5% of the cases go to trial because, you know,
you literally get a trial tax in federal court where if you go to trial,
you're 100% getting more time than if you take a plea.
That's not even a debatable issue because you get less points if you take a plea
than if you go to trial.
So, you know, if you go to trial in the federal system, you're already behind the eight ball because you're going to get sentenced to no matter what.
If you found guilty, you're going to get sentenced to more time than on any kind of plea deal.
And that's why I always argue that the system needs to be redone.
You know, like I want to go to trial on these cases, but my client is taking a plea to three years instead of looking at 20.
That's a big difference.
So it's like I'm not going to risk my client going to.
trial if I can get them out in what three years you'll get out in 18 months so all of a sudden
we're going to risk you know 20 years when you can get out in 18 months and everyone takes the deal
so like that's why they have such a high conviction rate what's the polymarket odds or the line
who what is that's a good one i'm not sure what the line is i haven't checked i mean i think
that you should do that you should go on and check what you said you believe at least at this point
it would be a clean sweep either way,
just because of how the charge is kind of...

But at the end of the day,
I think that it would be tough to split these up
and have a couple not-guilties and a couple guilties.
I think it would be a weird way they would get there.

You know, are you playing the cookout for tomorrow?

I guarantee you that everybody's working.
Nobody's, maybe they took yesterday off a couple hours.
Like, normally when I'm in a trial and it's a long weekend, like the Friday that we get out,
I relax, right?
You go to dinner, you relax, talk to your team, go over a couple things with your team,
hang out, enjoy your Friday night, but generally, first thing Saturday morning, you're working.
And then maybe you leave the office a little early on Saturday and then all day Sunday,
all day Monday, and then, you know, you're in court on Tuesday.
There's no vacations when you're in trial.
Like if you're, there is just no vacations when you're in trial.
You know, and I always say this, it's like, you know, there's sheep herders and there's
Spartans, you know, Spartans don't take the day off and say like, hey, let's relax today and not go hunting.
Like, you're a Spartan, you're Spartan.
So these guys are, everybody who is in this litigation field is a hunter.
And, you know, same thing with Drew and Brian and Brian's wife.
They're all, Brian's wife is fantastic too, by the way.
She doesn't get the credit, half the credit that she deserves.
Everybody talks about everybody else, but she's fantastic.
And, you know, it's just, that's the life that we chose.
So it's like, you know, you miss birthdays.
You miss different things because, you know, you're a litigator.
And you miss holidays.
Sometimes you've got to cancel vacations.
It's just, that's just the way that it is, you know.
And, you know, it's not an easy, this is not an easy road.
And especially when you have a good reputation, right?
When you have a really good reputation, it's almost, it's good and it's bad because everyone expects Billy the kid always to be the fastest gun in the West.
So it's like, you know, you have to live up to your reputation.
So for me, that motivates me to all, I don't care what case it is.
I don't care if it's a third degree felony or a first degree felony in federal court.
it motivates me to work harder to make sure I'm prepared more than anybody else to make sure
I don't make a jackass at anybody in court or the argument is wrong or anything like that
that motivates me to make sure that that happens and everybody is like that I'm sure
Drew's like that I know Brian is like that because we have a case together what would you
actually so you know know and but I guess it speaks to the friends that I have so I have

He was like, hey, listen, I was fighting a, he was fighting a murder case.
It was even though Albaed was in Canada.
And he was like, yo, listen, he says, as a defendant, I'll tell you what Dirk is going through.
And I guess I'm asking you in the roundabout way because I want to know what you would tell Dirk.
But he said, he said the last couple of days, he said he got not one night of good sleep.
He said he was up as early as possible.
he said it's really it's heavy on the nerves you don't know what's going to happen it's impossible
to have a really good night of sleep when you're in trial and your life is really your freedom
actually it's it's up so what do you tell your client what would you tell dirk if you're
a attorney so you know you're a counselor and you're a lawyer right so it's like you always have to
counsel your clients on like how they're feeling what they're
they're going through. And it's at a certain point, I think a lot of clients just accept that
there's nothing they can do more than that has been done. Like, I've had clients like come up with
case law and say like, hey, did you see this case? And I never have an ego. Like if I see a case,
one of my clients like 15 years ago, he's like, hey, have you seen this case? And he had this case.
And he's like, holy shit, I still use that case today. It's a great case. It was like, it was a really good case.
And I was like, no, I haven't seen that case.
So, you know, a client that participates in the actual getting prepared for trial,
but at the actual trial, other than taking notes and saying like, hey, this guy's lying about this or this guy is into this or, hey, you should ask him this question.
You know, most clients accept like, hey, listen, okay, I'm at it.
This is it.
And it's kind of like in my lawyer's hands and not to get, you know, religious, but it's in God's hands.
What's going to happen here is going to happen.
And, you know, we're doing the very best that we can.
And kind of when they accept that and it really helps them move kind of forward.
And it is what it is, bro.
It's like, you know, I've had rabbis and priests.
They say the same thing.
Your legs only take you where you're supposed to go.
And it's like, that's true.
So you got to have some faith in your lawyer.
You've got to have some faith in how the case is going and the different aspects of the case.
It's just very, very difficult for everyone, the family, the defendant, you know, the defendant's extended family or like girlfriends and everybody else.
It's just, it's a really hard time for everyone that's involved in these cases.
And on both sides, right, you got victims families.
What do you say to the family?
So we've been seeing his wife, his mom and his dad go in and out of that courtroom.
As, you know, his counsel, obviously, you know, maybe not in terms of the case, but, you know, I'm pretty sure they're always like, what are the chances he's coming home with us?
How do you?
They always ask.
They always ask.
What are the odds?
And it's like, you know, it's so difficult to say, all you can say is like today was a really good day.
And they'll know it.
Yeah, like, when you're in court, you get a fee.
of like today was a good day, today was a shitty day.
You know, but when the prosecution is putting on their case,
there's a lot of shitty days sometimes, you know,
because it's like even the first witness, like,
sometimes the first witness takes a day or two, right?
And like the family's like, oh, my God, like it was so horrible.
I remember my mom came to one of my first jury trials, right?
And the prosecutor does his opening.
And my mom, my mom is motioning me to come over to her.
she's sitting in the front row.
And I go over to the front row and she's like,
I think you're in trouble.
I was like, Mom, give me a minute.
All right.
Let me do my opening and then you'll make a decision.
So like I did my opening and we went through the case and it was really funny because we ended
of getting a not guilty.
But it was like the way that we got the not guilty was hilarious because some of the
witnesses just shit the bed.
And my mom at the end of it, she's like, you know, the first day that she was there,
she's like, oh my God, that first witness was so horrible.
And then all of a sudden you cross-examined him.
And then I thought he was a liar.
You know, it's like ups and downs and ups and downs.
And that's how trial goes.
So, like, you know, you try to comfort the family.
You try to comfort the defendant.
You try to do your very, very best.
And that's the thing that people don't understand, like, lawyers that really care about
their clients and care about the system and care about how things go,
it really does take years off of your life because you're like, you know,
you're worrying for your client.
You're worrying for the family.
It's not like, you know, good lawyers when they say like, oh, don't get, don't take
anything personally.
Like that and you're not a good lawyer.
Like I take everything fucking personally.
Like I take, you know, you know, I feel like I'm the only person who stands in the
way between my client going away forever or, you know, him coming home to his family.
And, you know, I always say if the system treats people fairly, if the system.
system was, you know, perfect, you wouldn't need all this, but the system is not perfect. It doesn't
treat everybody fairly. And even if you think somebody is guilty, that's not the system. The system
isn't you think they're guilty. It's whether or not you can prove that they're guilty and how you
prove it and how you got the evidence and how you did these things. That's why we have a constitution.
So, you know, it's very heavy. That's one of the reasons why you and Brian Steele, I think, you know,
So at least, you know, optically, I think you guys, to me, stand out so much more than maybe other attorneys.
I've seen you kind of really like whether on social media, definitely in court, like, really stand in the paint for especially Kodak where you're, you don't treat him like a client.
You treat him like, you treat him like family.

Or it looks like maybe you took out a large lump sum of money and it looks like maybe they got paid.
So now they're on a jail phone calls like saying, yeah, of course I got paid.

it's always better if there's no evidence of payment.
I think that always gives a bigger question mark on, you know,
essentially how it went down, why it went down, when it went down.
When you have payments, it establishes a timeline.
You know, there's a lot there that, you know,
that you wouldn't have if there's no payment.
So I always, you know, listen, if there's no payment,
it's always a better case,
but it doesn't mean that you can convict,
you can't convict because there is no payment.
But it definitely makes the case better.

Rule 29 is that the jury will enter a verdict of, well, not even a verdict,
will do a judgment of acquittal for counts that they,
believe there wasn't sufficient evidence at least displayed at trial that a jury even has to
think about.
From what I've heard is that there's no written motion yet, even though it was brought up
orally.
And we're going to see how the judge deals with that either on Tuesday or maybe that's
something that will come up right after we get the verdict.
And obviously it would only apply if the verdict comes back guilty.
other than the Rule 29, and by the way, the Rule 29 applies to two charges in particular.
The stalking, apparently the judge did rule that stalking.
If the person didn't know they were being stalked, is that really stalking?
So did Cuando Rondo LoPob know they were being stalked?

So if there was no proof that they knew or were in fear or moved different because of that,
that might be something that gets ruled.
29 means, though, the jury should not even think about this. This is, you know, not guilty.
Or it could go to a jury and the juror could then look at it and be like, hey, if the judge instructs us that if there is no knowledge of the stalking, it's not stalking, they might just say Derek is clear on that anyway.
When it comes to murder for hire, it becomes what was a value that got offered. We have three cooperators.
They basically all said different things. One said for life, the other said a million. The other clear.
that they were offered 20,000.

Then we have this Pinkerton instruction.

The United States Supreme Court addressed that issue in Pinkerton v. United States.
Walter Pinkerton and his brother Daniel lived on a farm in rural Alabama.
They conspired to buy whiskey in a wet county,
in the state and then sell it illegally in their dry ca...
Yeah, so that was during the prohibition error where it was illegal to sell alcohol.
And these people, you know, as the law was progressing in certain places you could sell alcohol,
but in certain places you couldn't, these guys wanted to sell, you know,
allegedly they were doing a crime by trying to sell alcohol in a place where it was, quote, quote,
of dry county.
And then sell it illegally in their dry county.
They also conspired to avoid paying liquor taxes to the federal government related to their illegal sales.
Walter proceeded to carry out their plan, but Daniel wasn't able to participate in the criminal enterprise
because he went to prison for unrelated crimes.
Federal revenue agents eventually discovered what Walter was doing.
They also discovered that Daniel had conspired with Walter but hadn't been a participant in Walter's criminal activities.
A federal grand jury charged both brothers with conspiracy to violate the tax laws
as well as with several substantive offenses,
that is, specific completed violations
based on illegal sales of whiskey
without the payment of federal liquor taxes.
The brothers went to trial.
The government's evidence proved the brothers entered into a conspiracy
but also showed that Walter alone committed the substantive offenses
without any assistance from Daniel.
The court instructed the jury
that they could convict Daniel of the substantive offenses committed by Walter
if Walter did them in furtherance of the conspiracy.
Daniel objected that he shouldn't be legally accountable for anything other than the conspiracy charge.
The district court overruled the objection, and the jury convicted both brothers not only of conspiracy,
but also of several substantive offenses.

So the idea of conspiracy to commit murder for hire.
So the Pinkerton instruction is, is instructing.
someone about or instructing the jury that not because Dirk didn't carry out or may have not
been knowledgeable or approve of every single step of this conspiracy, which means that maybe
he told them to burn the car and they didn't burn the car, not because that doesn't exist,
they can't hold Dirk accountable for everything that was done.
So essentially they're saying once you enter into the conspiracy,
everything that's done after you enter into the conspiracy,
even if it's beyond your knowledge,
without your consent,
or it's other people in the conspiracy that do it,
if their crimes as well,
you're held accountable.
So if Dirk was with the plan,
agreed to the plan,
even if he disagreed,
with how they did it, even if he disagreed or wouldn't have approved certain elements of it.
Once it's been committed, he signed up for the rest.
It's basically, I'm going to give you a better example.

He said if anyone wanted to watch television, he would turn the TV off or mute the sound

He said that young boy turned the television on when he wanted to watch.
