essentially Chud the builder his name is Dalton Etherly he shot a black male after he came out of court for some other issue and he walked outside the courtroom

he started streaming antagonizing a guy they got into it the guy eventually punched him and supposedly while falling to the ground he grabbed his gun and shot the guy or shot at the guy seven times. The guy has not died. However, while some people online tout that this is clear case

of self-defense, some people feel that this is a classic case of someone overstepping and using a gun to antagonize people and also trying to falsely claim self-defense. Anyway, he's been incarcerated on $1.5 million in bond. Actually, one million. in bond. It was 1.5 previous. It got reduced to 1 million. And currently, streamer Trud the builder has not been able to get out of jail yet. They had a bond hearing where the judge ruled on what would happen and how the court would accept bond for the million. And, you know, for all the people who say, oh, well, there's other cases that's happened in Tennessee where the bond was less. the judge explicitly said before the reason why his bond was doubled is because when it's routine

that when you already have a case that you're out on bond and you commit another offense or you're charged with another offense, we then double your bond. So this is something, you know, it's kind of crazy. We have, we have black folks on behalf of white folks claiming that this is reverse racism and he's not getting a fair shake, which, huh? But okay. And we have just chud the builder's supporters. Oh, well, why is he not getting?

Well, there is an explanation why his bond was doubled. Let's get to some of the quick details. And I'll tell you what the judge said afterwards. But this might be his lawyer. Let's see. A lot. And I understand Judge Polan saying, hey, you know, he's out on bail for other things. But let's look closely at what these other things are.

I mean, these are petty crimes. Even if they were true could result in a diversion. nothing that's and they're not frankly they're just ridiculous allegations so I would ask the court to take all this into account and to reduce his bail accordingly and allow mr. leverson to post his bail whatever the court thinks is appropriate and I can put proof on a proof on excuse me if the court needs that I have Mr. Ethelie's father here and mr. Rosen here to testify and we have a whole row of folks in support of mr. here as well, which again, that's, I mean, that shows he has ties to this community. Okay. Now we get the prosecutor who goes up. Despite what Mr. Finley says about the merits, it is in the system.

It is going to the grand jury. The Nashville case, theft of services was he went to a restaurant, ordered a lot of food. He was doing his streaming at the table and in the restaurant. They asked him a couple of times to stop. He refused. They asked him to leave because of that. And he said, well, I'm not going to pay if you're going to make me leave. So a little bit different facts.

And of course, on the way out, he's dropping all kinds of negative words at everybody. And that was the basis of the disorderly conduct. and I think the resisting arrest. So that'll be played out in Davidson County. If somebody can make bail, I think the only thing Mr. Finley needs to hear is what is the court's requirement, how many bonding companies and so forth,

and what would be the conditions from this court, according to the law for Mr. Finley and any third parties that want to postpone bond for Mr. Etherly I don't know where seems like that's what he needs to know from the court if he has people that can make the million dollars or any other way through a bonding company or companies that the court requires know why we're here but the facts of the matter of this particular case here given Mr. Etherley's business venture which is Chud the Builder is live streaming,

certain interactions with black people, saying derogatory things. We know what that is. Now, this is important. And, you know, we've kind of like debated Myron and, you know, kind of responded to how people have thought about this. And for the people who are stoic and stand on the, oh, no, you should be able to do whatever he wants.

Well, okay, all right, cool. haven't gotten to trial yet. And this part of the case, which is a bond hearing, this doesn't need to be beyond a reasonable doubt. You could bring in narratives. You could bring in behavior. You could bring in even how this guy feels about certain groups of people. All of this matters because it'll go into these certain things that are going to matter in determining bond. Is this person a flight risk? Are they a danger to the community? And how well could you guarantee that they're going to come back? So, you know, these details, while some people might disagree, like, oh, he's not antagonizing.

It doesn't matter if you have this technicality. If the judge or the prosecutor puts it across like that, it's depending on how the judge sees it. Causes an interaction and a response from certain black people on the street. I've been doing it for probably close to a year now. That's his stated purpose. So he goes out to intentionally insight and provoke black people for response. And that's what he did on May 13th. No legitimate purpose for being at the courthouse that day.

He had missed court at 9 o'clock. This is all proof that came out in the preliminary here. A default judgment was taken in a civil matter. Mr. Fox, however, was here on a child support matter with his wife to begin at 1.30. Who was here? Mr. Fox. That's the victim. That's the victim.

He's the person who was shot five times. He's the alleged victim in this case. We have tracked through video the exact moments that all parties arrived on the courthouse campus. Mr. Fox and his wife arrived about 108 from North 3rd Street and proceed to go to the main entrance and just sit on those concrete planners. Mr. Ethelie probably makes it to the parking lot about 112. starts walking across. That's on the North Second Street side, starts walking across.

Selfie stick in hand. Immediately walks right in front of Mr. and Mrs. Fox. And now we don't have audio yet of it, but he stops right at Mr. and Mrs. Fox. And what can only be assumed as starts his live streaming right there, the same thing he does approaches the first black people he could see. That happens for maybe a minute right there.

Mr. Ethelie walks away. Selfie stick in his right hand. He's still looking back at Mr. Fox over here. Mr. Fox is looking at him. Mr. Fox does get up and approach Mr. Etherly. Now, where does this interaction take place? I don't, it's closer to the north third street. So he's describing what was supposedly caught on surveillance camera and from all the evidence they have.

And this is important because we've seen some people who defend Chud the Builder. They claim there is exculpatory evidence that kind of show that he was being either pursued or confronted or he was trying to leave. And this other guy was, you know, closing the distance or, you know, trying to. continue with him while Tud the building was not violent. side of the courthouse as you're walking out the courthouse looking at the historic courthouse. What? It is on the courthouse property.

Oh yes. Yes. How far away from the plaza, the lack of better description. The plaza being that planned area. What was right, it had, all this occurred right at the last set of planners. Okay. on the left hand side. Mr. Fox is seen in the video,

making gestures to Mr. Etherly Mr. Ethelie switches his selfie stick to the left hand. He puts his right hand in his suit pocket. This is prior to any physical interaction.

Mr. Fox walks away from him. He comes back. Mr. Etherly He's trying to reach something out of his pocket. Just common sense says it's the fire on because he has a selfie stick in his left hand. And then Mr. Fox strikes him. As the gun comes out,

seven shots are fired within seconds. Five of them, I believe, struck Mr. Fox as they went to the ground fighting. That is the case. Like I said at the prelim, Some of these are going to be splitting hairs, some of this law about self-defense, the proportionality of a punch compared to using deadly force, whether there was provocation that negates the self-defense claim. All those things happen later. But some of these things showing just some poor forb-suff motive and intent, he has posted things.

on X, made other videos on X, what his intent is. For instance, on May 4th of this year on X, he posted, keep encouraging your fellow blacks to assault me. Oh, by the way, this was his, so the prosecutor brings up the tweet that he tweeted to me. And this is what I said, man, I think we tricked him off the streets. Remember, Chud the builder tweets at me. He tweets at me. he basically says keep encouraging your fellow blacks

and then he basically says I'm going to leave one of these chimps brains on the pavement because of you and I was like perfect well not perfect that he's going to kill somebody but I said perfect we'll use this later and it's now being used yeah I don't know if I can find it on his actual page I think he deleted some stuff deleted

but that was his tweet response to me X, he posted, keep encouraging your fellow blacks to assault me. Chudde build their posts on X. I will defend my life with lethal force. Do not approach me with intent to threaten bodily harm. And then he posts another response to himself. Does it rise to provocation when he then takes to the street and interacts with black people to get a response? Could very easily be provocation, which negates any self-defense, or the proportionality of the force used by Mr. Etherly to a punch in the face. He uses deadly force. There you go. Mr. Ethelty has to reasonably believe of imminent danger of death or serious bodily injury in that confrontation with Mrs. Fox. So there are legal aspects to the reasons why this was done and the actions my office took. And those were all the things that were argued. I think the bond is reasonable whether the court wants to put down.

And also, he has said that, um, no one bond company could give more than a hundred thousand dollars. So technically would have to take 10 bond companies. Now, here's the thing. freedom of consequences in businesses don't want to associate with you because they don't want to look racist, right? Like the law firms that's going to represent you, they're going to seem racist to other people that might want to consider them for their case. And the judge actually made it where it's going to take like 10 bond companies, but most of them don't want to be involved with this shit because they I would imagine if they're a bond company, most of their clients, not say most, but a good amount might be like people that might be minorities or African Americans or whatever.

Why the hell would you go bail out Chud? Then maybe in the future someone doesn't want to use your bond company because they feel like you're racist. They want to put it up on his behalf. You know? No. If you believe that much in Chud, do it the right way. The judge is, he's definitely being strict. He definitely thinks it's a serious thing. And if you want to put yourself in the line for a million dollars, do it the right way. I think Chud will get released.

It's just going to take probably a month or two more. But I think he'll get released in anticipation of his trial. Will he continue the same shit? We don't know.
