Starting point is 00:48:37 So his appeal, he had two appeals, right? One second. Wait, give me one. I want to make sure I read the full thing. Because I believe. So Tori had two appeals in. Okay. Let me start from looking at.
Starting point is 00:49:00 Tori Lanes was convicted of shooting Megastalian, right? Do I believe he did it? No. I think Meg's a liar. I think Meg's a drunk. And honestly, I do believe in my personal opinion that Tori Lanes was wrestling over the gun with Kelsey. That's my opinion, right? Regardless of my opinion, he was convicted of aggravated assault with a deadly weapon, right?
Starting point is 00:49:29 which is the shooting of Megastalian. He was sentenced to 10 years in prison. He was sentenced in December 2022. We're approaching December 2025. That's about to be three years. Now, even though he's sentenced to 10 years, he's going to have to serve about 6 to 7. Most places, and depend on what jurisdiction you're in,
Starting point is 00:49:56 in the feds, you got to do 85%. But California, usually a place with overcrowding. Sometimes it could go down to even 65%. Or some people even say 50-50. When I mean 50-50 means like as long as you do 50% of your time, you could be eligible for release. Currently, his parole date is 2029, which would be four years or now.
Starting point is 00:50:22 And essentially, you know, not only does he not want to be incarcerated for another, what would be, four years or not? years from now, his immigration status is up for, you know, it's on the rocks. Barring any last minute, you know, hurdle or last minute, you know, Hail Mary that he had, that establishes citizenship. Tori is a citizen from what we know and what everybody knows of Canada, not the United States. States. As usual law, federal law, definitely, but most states usually accept that if you are a immigrant, whether legally or illegally, if you then commit a crime that is punishable by over a
Starting point is 00:51:20 year and a day, which is usually called a felony, if you serve that time, usually they refer you to the federal authorities for removal or some people might know that process as deportation. Now, California is a little bit weird situation because California is, um, they're, you know, California, specifically Los Angeles, Los Angeles is known as a sanctuary city, which they usually don't refer their inmates to ICE for the deportation process. However, Tori is a famous celebrity. Ice knows approximately when he's going to get out. they're not going to let a guy who just did a felonious sentence go back into society without picking him up, right? So essentially, Tories pretty much going to get deported. What does that mean?
Starting point is 00:52:15 He's a musician. He's lived in Florida for years. He also lived in L.A. for a while. He would have to be restricted to going back to Canada and be ineligible of ever coming back into the United States for tour or anything else based on the fact that, he would be deported. So it's a big deal if he's deported.
Starting point is 00:52:34 Now, obviously for him, the main thing right now would be, how do I not spend the next four years in jail? And I'm saying next four years, because he's already done three, we're assuming he would probably get out of seven years when his parole date is, which would be in 2029. He had two appeals open. One appeal is what's called a, he submitted a writ of habeas corpus.
Starting point is 00:53:05 And I've explained this before. They make the legal shit sound very difficult, but it's not. habeas corpus is a Latin phrase of, you know, it's a plea of innocence. Or it's a show me the proof why you're taking someone's right. Now, you could have a writ of habeas corpus for any. anything if you feel your, you feel that a right that's guaranteed by the Constitution is actually
Starting point is 00:53:39 being deprived of you unlawfully or without proof or anything else. So this is a Hail Mary appeal, that particular one, but it's basically says, you have to show me why I'm locked up. Now, the first thing they're going to say is you're locked up because you went through a legal, fair, and just trial that a jury of your peers convicted you in. Right. Now, of course, Tori's going to have his retort to that. But a writ of habeas corpus is what I call a Hail Mary. If anybody's familiar with football, Hail Mary is usually like, yo, it's like fourth and 45. Okay?
Starting point is 00:54:24 it's just that type of situation. Meaning that it's a long shot. It's a long shot. Because generally speaking, most of the reason why you'd be locked up would have some legal process. Like, for example, if they just took you into custody
Starting point is 00:54:42 and they held you for, I don't know, they had you for three months at a county jail. You have no charges. Now, usually, you know, a writ of habeas corp would bring to the attention to the court to say,
Starting point is 00:55:00 hey, my client is locked up without any charges and he's been held and detained unlawfully. He needs his freedom immediately. And that's a typical way how a writ of habeas corpus would be used and it would be granted. Right? Okay. So, again, you know, and I'm,
Starting point is 00:55:26 I'm explaining this kind of laboriously, but I want you guys to understand it because it's two appeals. And I'm going to get to the more relevant appeal that was denied. But this appeal, it's a long shot. It says, y'all are holding me against my will or you're depriving me of my freedom for no reason, right? Or not a law for a reason. It's a long shot because the mere fact that you got indicted, you got you went to court, you picked the jury, They had a whole court case. It kind of, that is the reason why you're locked up.
Starting point is 00:56:02 So a writ of habeas corpus is usually if, say they just pick you up, say they're having some investigation, they pick you up and they have you locked up for 20 days. That's a good way to get out of that, right? Okay. Now, the other appeal that he had was appeal for a new trial. And Tori was saying that the trial was fucked up. It was scuffed. Things were introduced that shouldn't be introduced.
Starting point is 00:56:24 his lawyer wasn't, you know, was a conflict of interest. He brought up many different things that he wanted a new trial to try to prove his innocence. Now, the road to freedom, if you are granted a new trial, is that you could be granted a bail pending a new trial. And for some situations, like this case probably costs half a million dollars or more to try for Tory. Maybe the prosecutors are like, yeah, we don't want to spend that again.
Starting point is 00:56:58 We're not even going to do it. So you're free, right? So that's another way. The appeal that got denied, and it was really affirmed, is that the California Court of Appeals has affirmed that Torrey Lane's prison sentence
Starting point is 00:57:13 and his appeal for a new trial, they don't see the reason for a new trial. Now, I'm going to try to get into a little bit more details, because there's actually paperwork on this. And by the way, this is the court's opinion. And yes, Tory could still appeal this appeal and really appeal the same thing, but just to a higher court.
Starting point is 00:57:42 It will go to the California Supreme Court. So the way how appeals work, you have the local or county courts, which is Los Angeles County Court. They sent him to jail. He kind of appealed it. to kind of what's like almost like a circuit court, but it's a little bit different. I think it's a superior court or something like that. I forgot what it's called.
Starting point is 00:58:04 And then after that court, you'd have to go to the California Supreme Court. And after that court, if that court also still affirms it or denies him a successful appeal, his last option would be to the Supreme Court of the United States. right so the federal court actually listens to every issue in America to be honest the Supreme Court is not going to listen to this Tory case there's nothing of you know constitution relevance that they would feel that they would need to rule to clarify an existing rule or prior rule or or taking an account maybe other rules in the past so they're not going to listen to this case California's um
Starting point is 00:58:54 Supreme Court, which is, it's just a Supreme Court for the state. Would they listen to it? Probably. But still, I can't see anything. And I want to be realistic with you guys. And I'm a Tory supporter. So what am I saying? Tori's not getting that on appeal, people.

Anyway, it says after hearing further argument from both... the defense in the prosecution. The court concluded a prosecution had proven beyond a reasonable doubt that the victim was vulnerable within the meaning of the rule. The court viewed Peterson post-incident conduct as a major aggravating factor in this case.
Starting point is 01:01:33 So they're affirming the sentence by saying, no, you deserve 10 years because of how you acted after the incident. With respect to the mitigating factors, the court found Peterson's participation in a charitable causes to not be very significant. They said that Peterson had been an asset to the community and held people out, and it wasn't a recognized factor in mitigation, but it was important nonetheless. Similarly, the court said that Peterson's low risk of violent recidivism was not a major factor, but it was a factor. The only one of these findings,
Starting point is 01:02:13 Tori Lane's actually challenged on appeal, is the vulnerable victim finding, referencing to Harris, which is Kelsey Harris, statement to the prosecutor is that she saw Peterson reached towards the center console after threatening to shoot her. Peterson contends that Pete,

So when you get to appellate court, you submit a brief, your opponent, or in this case, the prosecutor, they submit a brief. The judge reads both briefs. Just because you're signed to the same label as another artist or you move in the same social circles, does it mean that you're automatically going to be cool? Everybody wants to be the biggest artist in the world, and when another rapper comes along and steals your shon, things can get heated. The most recent rap beef to make headlines is none other than the feud between Little Baby's 4 PFF crew and the Migos. Let's take a look at what we know about the beef between these two groups.
Starting point is 02:09:46 Both Migos and Little Baby are signed a quality control records, also known as just QC. QC was founded in March 2013 by Kevin Lee, also known as Coach K and Pierre Thomas are just Pete. Both men are respected names in Atlanta hip-hop and have close ties to Gucci-Mane and other famous drill rappers from the city. Other artists signed to the label include Lil Yadi, The City Girls, Duke Deuce, and many more. Plus, Cardi B is signed to a management deal through QC, so the label has a small yet exclusive roster that includes some of the biggest names in hip-hop. The Migos were one of the first acts assigned to the label, and for a long time, they were running the show. Migos were originally part of the 1017 family, and Gucci was one of the first rappers
Starting point is 02:10:24 in the industry to give him a co-sign. But after he went to prison, Gucci Mane and de Corp, he wore handcuffs on his way out. A judge revoked a year of the probation, sending the rappers straight to the Fulton County Jail. Coach K&P stepped in to take the Migos under their wing. They released their debut single Versace under the label, which was followed up with the remix by Drake, and ever since then, the group has been dominating the charts. For a long time, the Migos were the stars of the label. With hit records like Bad and Bougie, Fight Night, Look at My Dab, and Motorsport,
Starting point is 02:10:55 the Migos were on fire from, while Baby is from the Jones. It says, yeah. Did you hear the record I'm talking about? Although, any public beef between Baby and Amigos, they just seemed to move in their own separate ways. In an interview with the Breakfast Club, Little Baby said that he and the Migos didn't have a relationship like that. He didn't say there was any beef, but they just did their own thing musically. Then, in March 2020, rumor started going around that Offset had been jumped by Little Baby's four PF Goons outside the release party for his album My Turn. Witnesses who were allegedly at the party said they saw Offset get jumped, Rob, and,
Starting point is 02:11:29 and stripped down to his boxers. A video also came out that supposedly showed the fight go down. Although, it's filmed from a car parked far from the action on the other side of a fence. The video does show some kind of altercation and you can just barely hear Offsett's name and other threats being made, but it's far from solid evidence. Several rumors were floating around as to why Offset and Baby may have had problems. One theory was that Offset ended up getting into it with some people, which resulted in Little Baby almost getting robbed, even though he wasn't involved in the situation.
Starting point is 02:11:59 The theory was that Offset owed someone in Baby's camp 50 racks but refused to pay, so they beat him up. Both Little Baby and Offset denied this rumor. When the blog reported the story, Baby commented on the post saying it's all capped. He also posted a slides of his Instagram story with the caption, Stop spreading fake news. That's fake, please. Offset also posted a video on Instagram showing his face to flex that he didn't get scratched up.
Starting point is 02:12:23 We're not really sure what to make it a whole thing, but the fact that neither side wants to talk about it is just kind of weird. The rumors died down after a while because it was the word of some random fans on the internet against the two people who were allegedly involved. So, even with the videos as evidence, it isn't much of a beef if both rappers deny they have problems. But fans also noticed that Offset had unfollowed both Lil Baby and P on social media, suggesting that maybe there was more going on behind the scenes than fans knew. Later that year, the Migo shocked the rap community when they filed a lawsuit against QC
Starting point is 02:12:55 for allegedly stealing millions of dollars from there. They actually sued their former attorney, Dammy, so he was clearly referencing his label mates. Since they are rumored to already have beef, the post led fans to believe that another altercation had happened between the two crews. There wasn't much context to it, and this time, there weren't any witnesses to report what happened. But as more clues come to light, the more it seems like the beef between Baby and Meegos is real and not just drama made up by fans. None of the rappers involved have addressed the Cahill Baby. The Meek is he isn't all that specific, so he could be talking about Little Baby or any other. rapper he came up with who started all right so I mean look like something happened I think baby
