Locked On Jayhawks - Daily Podcast On Kansas Jayhawks Football & Basketball - ELIGIBILITY FIGHT: Kansas Basketball’s Melvin Council Jr. TAKES NCAA to Court—Will He RETURN for KU?

Starting point is 00:00:00 Melvin Council is officially going to court. Sue in the NCAA. What does it mean for him in Kansas? We will go through the show today, get to the Jayhawks TBT team latest with them.

Starting point is 00:00:30 We're going to break down plenty more on the Melvin Council situation. And does KU have enough shooting around Melvin Council to make it work? I think that's kind of the biggest question for most people right now. And we're going to start right here because Melvin Council, the I guess former one year to this point, Kansas Guard, trying to be a two-year Kansas Guard, has officially sued the NCAA. And so there was actually like a photo posted that was going around social media from counsel earlier in the day of him in a suit, kind of dancing, getting ready for something and kind of made people believe, okay, is this the court date? Like why else does, you know, what else is he dressing up for?

Starting point is 00:01:06 You know, is he going to a wedding? Is he, you know, on a Monday, though? It's like, what's going on there, right? So he ends up, yeah, that comes out that he's got a big lawyer team. It's like five lawyers or something like that. Suing in the Douglas County. And he is officially in the transfer portal just to, you know, because you didn't know how long this was going to take. I mean, clearly it's taking long.

Starting point is 00:01:26 So you want to keep your options open just in case K.U. You would have filled up. The fact that he's so beloved by Kansas that I think Bill Self, you know, know, loves Melvin Council and the fact that this being filed in Douglas County, I think to me, not that that was really in question at this point, but if he did have any question remaining of, oh, if he does get the year of eligibility, will he be back at Kansas? Or could it be another school. I think that probably, you know, kind of wraps it up that that would be the idea that yes, he would be back in a Jayhawks uniform this upcoming year. And so he's trying to get another year

Starting point is 00:01:53 of eligibility here. Obviously, he had his waiver denied back in May by the NCAA, which is why we're here where he is suing the NCAA. And he's not one of these people who can get eligibility off suing off the, you know, what you're seeing a lot of these other almost like class action lawsuit type of things where you're getting a bunch of players jumping on board from some of these different states to trying to get the five and five retroactive to them. That does not apply for Melvin Council. He does not fit into the five and five.

Starting point is 00:02:27 He is trying to fit into this world of just, just getting an extra year by his juco seasons, not counting against him. And do keep in mind the current players, they have allowed them or have basically offered to say, you can go by the current rules, you can go by the old rules. So essentially it would be Melvin council saying, I want to go by the old rules. And then I want to have neither of my juco years count against me. And so basically, if you remember, the reason Melvin council was even eligible this past season to begin with is because of the Diego. Pavia ruling.

Starting point is 00:03:01 That basically set a, I don't know, a ball in motion, so to speak, that eventually led to Melvin Council and other players getting eligible to where Diego Pavia sued the NCAA that his Jucco year shouldn't count because basically he, it wasn't actually a D1 season. And, you know, was preventing him from making a bunch of money in NIL from that season, you know, being counted against him, right? And that he wouldn't have that opportunity when he was playing Jukobass or Jukon football. And so that was taken by the players like Melvin Council who did spend two years at, you know, the Jukau level and then went off and played two years, Wagner and St. Bonavits, or he

Starting point is 00:03:40 wouldn't have been eligible last year for Kansas had that ruling not happened. But now he's basically taking this and saying, hey, the one year of Juko doesn't count. Why shouldn't the, or why should the other year count? And I do think there is some logic in that to me. Like we can talk, we can go back and forth on like, should the juco years actually count or not? You know, if you're asking me honestly, probably the juco year should count. But now given that a court has, has deemed that those one years of juco did not count, why does the one year of juco count, but every other player's season of juco does count? You know, what if you're a player that played juco in two other seasons? Does one of your years not count? Well, what should make one year of juco different than the

Starting point is 00:04:29 others. So if that's the rule that that we played against, then I do understand the logic for why that should allow you to be eligible. And then if you're just looking at the D1 seasons, you have three division one seasons played for Melvin Council. This would potentially be his fourth year if he can get that extra year. Henry Greenstein from Lawrence Journal World and KU Sports.com, we're going to try to get him on later this week. And he turned it like this in his article on it. He said he is seeking an injunction that would make him immediately eligible based on the fact that has played fewer than four years at NCAA institutions. It was also kind of mentioned in this,

Starting point is 00:05:03 some of the phrasing kind of talked about the idea that, like, he wanted to make sure that if he was eligible, this would be something that the NCAA could not retroactively, you know, kind of sue about that like in five years from now, if he was eligible and played all these games, that they could go back and be like,

Starting point is 00:05:17 well, no, technically by these new rules, you're ineligible and we're going to take the way those wins. That's something that he's kind of looking out for, which is kind of a cool thing that he's looking out for as part of this as well. The article also adds the lawsuit was filed by Lawrence Attorney Terrence J. Campbell of Barbara Emerson, along with the host of Philadelphia-based attorneys from Archer and Griner. It names both the NCAA and Illinois athletic director Josh Whitman in his capacity, who I guess he's serving as the Division I cabinet as defendants. And it is accusing them of breach of contract based on counsel's status as a beneficiary of the NCAA's agreements with its members institutions.

Starting point is 00:05:53 and then some other legalese words, but basically interfering with his ability to sign, contracts to play basketball or profit off his NIL. And again, you can read more about all this in the Lawrence Journal World with Henry Greenstein's article. Now, it also goes into detail on what is another, I think, pretty big piece of this suit here,

Starting point is 00:06:16 which is the idea that the whole reason that Melvin Council was put into junior college basketball, goes back to a court case that wound up he was, you know, proven innocent in. And there was basically a rape case that was back from, I guess it would have been when he was in high school that it ended up, he was found innocent of. He was found, you know, there was evidence in the court. He was like cleared of everything, right? So like, we don't need to talk about that case.

Starting point is 00:06:46 Like he was cleared in the court of law and everything. But and even so, like there's, there's quotes. in the article from Henry talking from even the district attorney that's like, yeah, I'm wishing him the best and stuff like that. So like, point being that basically the argument is that that prevented him from getting to play division one basketball out of high school, which I think is a fair understanding of saying that like, listen, would he have been able to go to Kansas right out of high school? No, but would he have been a, you know, Division one been major player? Probably. And would that have accelerated the timeline to where, you know, he could have gotten to Kansas a year earlier in his career or school to that akin? Yeah, probably.

Starting point is 00:07:28 know. Um, and so you're basically putting him in a situation where, you know, he was, he was the culprit of something he didn't do and got thrown under the bus here to where it put him in a situation where, you know, now he's having to sue for this. So we'll see if that plays, uh, part in this at all. Um, obviously it could have, and again, I would recommend reading more about it and Henry's article again, we're going to try to get him on later in the week here. You know, we've seen other players be able to win not necessarily this exact way, right? It's not this exact story or whatever, but like win this way. When I say this way, I mean by taking the NCAA to court and winning at a local court where a judge gives you the injunction.

Starting point is 00:08:16 I mean, shoot, everybody thought Brendan Sorsby was going to be ruled in eligible. And even he was able to win his way through court at least until, you know, stuff hit the fan from then on. and they tried to go the different route and just kind of let bygones be bygones there. But like, you know, this one to me has more ground than that one does, right? Like, anyway, we don't need to be comparing this or that. But like, point being, this is the way that a lot of people have won through local courts, right? And it definitely does feel like the NCAA is doing everything in their power to push back right now. They are really digging their heels in against this, which again, like, if they would have just made the five and five retro,

Starting point is 00:08:55 retroactive to this class and just said anybody outside of that, sorry, you can't make it. They wouldn't be probably having to even deal with this for Melvin Council, but they opened up their own can of worms here. I just wonder what the timeline is for this, right? Because the school year for KU starts in about a month at this point in time. I think it's a little, even less than that than a month. Now, is this something where theoretically he could join, I don't know, midway through a semester? I don't know how that works. Would he have to join at semester. If this thing carries on too long, that would certainly make things more difficult with integrating a player of his orbit with these other players. So it gets kind of complicated with

Starting point is 00:09:36 is the timeline going to be fast enough here? I would think the fact that it's a local court would allow for KU to be in a good situation timing wise. But again, you know, it's tough to say with some of these court type legal things, right? And then what happens if it's appealed? How long does that take? Is it something, where KU can just expect to play him till he, like when Charles Bettyaco was playing for two weeks, still, you know, he was announced he couldn't. I don't know.

Starting point is 00:10:02 It gets kind of complicated here, right? So when you're looking at all these moving pieces, it does make it like, again, that word complicated, right? But I still am a big believer that adding Melvin Council would go a long way for improving KU as a team and improving their floor of this team. And I think the biggest pushback that you've seen so far is, well, what about the shooting? Would he have enough shooting? would he take away from Tyrant Soak's driving ability if he's not being defended.

Starting point is 00:11:53 This anniversary won't last forever. Thanks again for joining us here on Locked on Jayhawks. And I keep seeing it that shouldn't say keep seeing it. I do think a the majority of KU fans want Melvin council back. I think there's the majority that want that. I think there's a another piece that's kind of like, well, I'm worried about this, but I like watching him a lot. So cool it's having back.

Starting point is 00:12:22 It's probably another sliver of people that just like, I don't really care. Like let's just see what happens in the season. And then there's a pair of people. And again, it could be 2% of the fan base. It could be 5%. It could be 10%. It could be 15. I'm not entirely sure.

Starting point is 00:12:34 But whatever that number is of people that that is more hesitant to the idea here is a very vocal minority about this kind of happening. And I understand it to a certain extent in the vein of like, well, KU hasn't had enough shooting in some of these recent seasons. And, you know, I've also seen the idea. I've seen some people being like, well, I'd love that Melbourne council back. he's their sixth man, if he's their backup guard, if he's playing 20 minutes per game, can we just be clear with this, you're either fine with Melvin Council coming back as a starter

Starting point is 00:13:07 or you're not fine with it at all. If you're saying, hey, I'm fine with it, coming back as a six-minute. Okay, but that's living in La La Land. That's living in fairy tale land. Bill Self is not going to bring Melvin Council back a returning starter who he loves to death and is a really good defender and can do some positive things on the floor. He's not going to bring him back to be a 20 minute per game guy. That does not happen.

Starting point is 00:13:27 He's either coming back to play 28 plus minutes per game or he's not coming back at all. Okay. So let's make that completely clear that you can't just be like, oh, well, you know, I'd love for Hakeem Elijah Juan to come off the bench as KU's bench. Like, I get it. That's an extreme example. But like, you know what I mean. Okay.

Starting point is 00:13:46 But like, again, I get it. KU hasn't had enough shooting in recent seasons. I don't think that applies to this year's team. And here's why I think this team has enough. shooting. I'm not saying this team is going to be like a 40% three point shooting team, but I think the biggest detractor for like to me it's less about is Kansas going to be 35% from three as a team compared to 39% like sure it'd be great. But it's more about are you being guarded in a way that you are getting respected that can leave driving lanes open that can

Starting point is 00:14:18 leave guys open if you throw the ball to them down low that doesn't screw up your spacing as a team. And at the end of the day, if KU was rolling out like two non-shooters plus Melvin Council, like if you were rolling out Melvin Council, a wing who is a shaky shooter, a big man who can't shoot at all, like I mean, again, like the last year's team, right? You're rolling out Melvin Council, who's a below average three-point shooter with Bryson Tiller, who basically non-three-point shooter after the North Carolina game. but had a few moments here or there. So if you want to say even, you know, just poor three-point shooter, a non-three-point shooter in Flory Bedunga. With Darren Peterson, it's like, you know, very good three-point shooter. He wasn't always out there, though.

Starting point is 00:15:09 Jamar McDowell just depended if he were home or away. Trey White was a little inconsistent here or there. You didn't have the consistent most shooting kind of around him at all times, right? And, you know, like, that's why you brought Cole Rosario last year. and he didn't end up getting the shooting. But if you look at this year's team, I look at Taylor and Kenny, if you include his preseason, regular season,

Starting point is 00:15:31 postseason numbers from OTE, 36% from three, okay? Now, I get it, OTE, not the most organized basketball, right? The defense can be suspect at different times. But I don't know, like, I think Kenny's going to at least be an average shooter. Can he be 33%, 34% from three?

Starting point is 00:15:51 I think he can, you know? You look at Leroyd-Blyden, 40% from three last year. Sure, he jumps up in competition, but a lot of times the three-point shooting stays what it is. And I think Blyden will be a really good three-point shooter. You look at Tyrant Stokes. He was like 36% from three last season, you know, even if he takes, even if, again, he's just average, 33, 34%, you know.

Starting point is 00:16:13 You look at Keanu Daz. Sure, 32% from three on the season would be closer to average, slightly below average. He shot 37% from three in Big 12 play. and that's one of the big things he's working on the offseason. So like, why can't he be an above average three-point shooter? Absolutely think he can't. You look at the potential bench guys for Kansas.

Starting point is 00:16:31 Well, the idea of Cort Rosario playing big minutes for Kansas comes with the three-point shooting and proving to what you would hope it to be, at least average from three-point range. Dennis Perker Jr., you know, 38% from three last year after working on it a ton over the off-season. Should at least be an average three-point shooter. If you play Luke Barnett at all, he is going to be a really good three-point shooter. There's a lot more three-point options around you this game. go around to make it work with Melvin Council.

Starting point is 00:16:57 And then, you know, I think in general, like the way I look at it, when I look at other constructions of good teams, you can have one non-shooter and I think one poor to below average shooter on the floor. As long as you have either three solid ones or like two elite ones, I think you can make it work. So like, let's look at last year's final four. Roddy Gale was at 31% from three on low volume. He was a starter.

Starting point is 00:17:21 and at times they're playing two bigs with Johnson next tomorrow. But even if it's just one big with Gail, you know, that's one non-shooter and one below-average shooter. And they won the national title, right? Arizona, like, I could tell you that, you know, Crevis and Pete were non-shooters at the four and five, and Karchankoff was below average. And that's all true.

Starting point is 00:17:42 But, like, that was a team who was an aberration in terms of how they got it done. Like, they were one of the best defense in the country. They were one of the best rebounding teams. Like, they did everything else extremely well. so it just didn't matter. When you look at Illinois even, like they had a team that could really space the floor and go five out,

Starting point is 00:17:58 but like Colin Boswell, one of their starters, shot 30.7% from three. Andres Stoyakovich shot 24% from three, you know? And even the big men who we look at and say, oh, well, they had stretch fives. They're shooting like 31% from three. So, you know, at different times,

Starting point is 00:18:14 they're having two below average shooters on the floor at all times for Illinois. You look at Yukon, solo ball, only shot 30%. percent from three is their starting guard. And then they, their five men were non-shooters in Terris Reed and Eric Ryba. So again, like that would be the equivalent of KU saying, hey, M. B is a non-shooter at the five. And Melvin counsels 30% from three like solo ball, but we're going to have enough shooting two through four, you know? And then what if you go back

Starting point is 00:18:41 to the 2025 final four, you know, Duke had everything. So, you know, whatever. That's the, the tale of, as a lead of a team as they were. Obviously, they ended up choking in the final four, but you look at Houston even. They had really good shooters one through three, though. If Milo Suzan would have shot like he did from three this season, as opposed to that season would have been a different story. But they had non-shooters at the four and five. And they made it work.

Starting point is 00:19:03 Probably should have won the national title. Depending on the lineup, Florida threw out there. They had the elite shooter in Walter Clayton. It was like two to three other average shooters, guys around 34, 35, 36 percent. And then one to two non-shooters on the floor, you know? For Auburn, who made the final four that year. John I Broome only shot 28% from three, starting at the four.

Starting point is 00:19:24 Their five men didn't shoot threes. And then they had another bench player who was basically a non-shooter. So like, point being, you can get away with it if it is a smaller number of players. And I look at the rest of like the KU players who are going to be on the floor who are not five men. And I'm like, unless Trent Perry is playing a role on this team, which I'm not projecting to, KU should have more than enough shooting around Melvin Council to make him work. right if you're starting counsel next to blighton with dawes and bia and stokes if you want to say stokes is an average shooter blighton's a good shooter daz is an above average shooter with counsel who is a below average shooter and then a non-shooter at the five i think that's enough you know

Starting point is 00:20:04 and then that's not even in counting that you would have therefore three shooters off the bench who could come in and make threes for you i guess even four if you counted kinney rosario barnett and parker right and then if you do end up bringing in mahalo moussich and he ends up being good enough to be in the rotation or good enough to play, that's a five men who can theoretically shoot a three and space the floor for you. So I think they have enough shooting around Melvin Council to make it work better than it did last season. And I had fun watching Melvin Council. I really enjoyed him. He was my favorite player on the team.

Starting point is 00:20:33 So I'm all about Melvin Council another year. But I don't know. Have you dug your heels in the sand so much if you're anti this that what I just said is going to go in one year out the other? I don't know. All right. Let's finish up TBT. What a finish for Jayhawks TBT who is moving on once again.

Starting point is 00:22:15 So congratulations to Jayhawks, the Hoops, the Kansas alumni team in the basketball tournament. This is the furthest this team has ever made. Obviously, it's a different format and everything is part of this, but it's the most wins they've had in a tournament. It's the deepest they've been. They're now playing for the alumni championship against the Kentucky team on Wednesday. It was a wild game. So if you missed it, KU opened with the Kansas State alumni team on the opening round, I guess, a best of three series.

Starting point is 00:22:50 They lost game one in blowout fashion. We're getting beat, you know, decent amount in game two, big time comeback, killed it in the Elamanding, forced to game three. They're down a little bit in game three for a majority of the game, and then again, they come through winning the Elam ending. Well, now you're playing on the road in Wichita against the Aftershocks team that has typically done so well, year in and year out in this event, and always has such good support. KU fans really showed out in the arena to be.

Starting point is 00:23:19 clear down at Charles Koch Arena for this one. And if you missed the game, I legitimately recommend going back and rewatching the game because I have never seen anything like this. You get early on in the game, it's just kind of a back and forth game. Neither team really pulled away. Wasn't the prettiest game in the world. I mean, it was 64 to 59. Neither team was making a ton of shots. I mean, Frank Mason finished 5 of 21. I think at one point he was one of 12. So actually finished strong there, but like, you know, the KU team shot third. 39% 30 from 3, only 59 at the foul line. The Aftershocks team only shot 33%, 23% from 3, and 69% of the foul line.

Starting point is 00:23:58 So again, it wasn't the prettiest game that you're ever going to watch. But what made this spectacular beyond, you know, them winning the game, second quarter, there is a tussle for a rebound between Mario Chalmers and one of the, the Wichita State players. And it leads to a, I don't know, not really a fight, like more of I guess you would say, like a wrestling, shoving type match. but both players have, or both teams have players leave the bench

Starting point is 00:24:23 to come kind of surround the area. And like everybody who left just gets, who wasn't, you know, actually on the court already, gets ejected from the game. So both teams wind up with just six players, five on the floor and one player on the bench.

Starting point is 00:24:36 So it's six on six basketball. Both teams are having to grit it through, stay out there forever, avoid foul trouble. And somehow they find a way, I mean, it was Frank Mason, Jacob Hanna,

Starting point is 00:24:48 Carlton Bragg, like Zeke Mayo, Billy Preston, and Andrew Orr against the six guys for Wichita State. And cool to see that Frank Mason, yeah, I mean, cool to see for Frank Mason for a couple of reasons, right? And I guess Jemari Trailer would have been on this team. I'm trying to think what Carlton Bragg. I don't think so. But we're on the team at Kansas that lost to Wichita State in the NCAA tournament. I know this doesn't replace that, but it probably felt good for them.

Starting point is 00:25:14 Beyond that, it probably felt good for Frank Mason to beat Connor Frank Camp, right? that was a guy that you were going up against in practice every day. And obviously, you know, ended up working out for Frank at KU more than it did Frank camp, but still feels good to, you know, kind of get that done for him. But Frank was the one who hit the game winning three. And Frank actually had the last six points. He was up until that point. He was three of 19.

Starting point is 00:25:34 But you always just trust Frank Mason in those key moments. And he hits back to back threes. He hits the game winner from like 30 feet. And KU is moving on again. And like there's good news, bad news now. The Kentucky alumni team is very loaded. The good news is all the guys that were ejected from this game, like Mario Chalmers and whatnot,

Starting point is 00:25:57 they're going to have more fresh legs now for Wednesday for Kansas because they didn't get a full game in, you know? The bad news is the guys who did have to stay out there for Kansas are going to have the opposite of that. They're going to have dead legs coming in that game. So it would be very, very interesting how KU manages some of the minute stuff there. But yeah, Frank Fincher's of 13. Jacob Hanna, I've been so impressed with during this TBT, man.

Starting point is 00:26:15 the Washburn star. He was taken on the challenge defensively. Marcus Keene, who's a very difficult guard. He had 15 points, 6 rebounds. He's been really fun on both ends of the floor for Kansas. And honestly, like, you can make an argument. Zeke Mayo has been KU's best player for the TBD so far. He had like 25 and one of the last two KState games.

Starting point is 00:26:34 He has 25 points in this game. And for majority of the game, he was KU's offense, you know, because up until those last two threes, Frank Mason only had seven points. So Zeke Mayo had 25, Hannah had 15, and nobody else had. more than seven. So that was pretty incredible. And then, yeah, you get six rebounds from Bragg. You get five from Orr, who continues to kind of play well as a Washburn kid as well and fill into a specific role that they need them to have. But yeah, now difficult challenge with Lafamelia, the Kentucky alum, but really cool run and really cool as a like, I always love this event each and every year.

Starting point is 00:27:05 And I'm never going to deny getting to watch extra Frank Mason basketball, you know, favorite KU player of all time and getting to see every extra minute has been really, really fun to watch, right?
