In this episode, Dan will give some pointers on how to prevent problems from happening and which issue you should overlook before accepting the offer.

When you receive an offer, you're going to want to make sure that you summarize it with the seller.
You're going to make sure that you're explaining the pros and cons of each offer.
There will be times when it's not always going to be the highest priced offer that will win.
Your job as the agent is to sit there and say, I got the offer coming in.
What's every single freaking thing that could blow up in this deal?
So most likely, it's going to be financing. Secondarily, it could be an appraisal. And then
thirdly, it could be a mistake that you make. And I've had the unfortunate experience of all three
of those. And so the mistakes that you could possibly make,
those should be avoidable. All right. So in Virginia, for the resale documents,
then that's now a negotiable timeline between the buyers and the sellers, yet it's still a timeline.
In every state that I'm aware of,
there's going to be some sort of disclosures provided between the sellers
and the buyers, not between the sellers and the buyers,
but, well, it is between the two of them,
but it's coming from the association.
There's going to be resale documents.
They're going to have a certain amount of time to review those documents,
and then you're going to have a right of rescission.
So a right of rescission is the biggest protection that a buyer could have.
So understanding that a right of rescission is even more powerful
than a voidable contract or even a voided contract.
Because in a rescission, it means that the contract never happened.
An avoid contract, it means that it happened and then there was a legitimate reason to say,
X, we're not going forward. And then an avoidable contract, it means that one party
has the ability to avoid the contract, but they've not yet exercised it.
Okay, so that's like the differences between there. So you go back to those three things to
pull the grip of transaction, the one that should be a non-starter, like a 100%,
making sure that you are not screwing up anything in the dates. I've unfortunately had one transaction that
we were representing the seller. The homeowner association documents were never delivered,
the resale disclosures. And two days before closing, they backed out. And the disclosures
were never delivered. And they had every right to back out.
Because that contract, if you're in that situation, and if that's the way your state works, then that contract during that time period is you have zero protection for the seller.
Zero.
And then once upon a time in Virginia, Maryland, it was a, and I guess it's still that way in Maryland, but once upon a time in Virginia, it was a three-day right of rescission period from the point of when they received the documents.
Today, when we're writing the offers and receiving the offers, you want to make sure you're looking at that date in the contract to make certain that that date is however whatever it says that you're aware of it thanks so much for listening to the no broke months podcast today until the next show
