Starting point is 00:11:17 I mean, I saw, I saw acquitted on all charges and I thought, okay, well, I mean, that's I mean, then the judge threw his gun back to him. He goes, hey, kid, you mean, that's, and then the judge threw his gun back to him. You guys, hey, kid, you know, there's a kid catch. Yeah, you're gonna, don't forget this. Nick, just in time, kid, we need your help. No kidding. Have they burned anything down in, in Kenosha yet protesting? No, they're burning things down in other cities, of course, because that's how these things
Starting point is 00:11:43 operate. Yeah. Kenosha's been pretty muted from what I've seen. They had, you know, right after the verdict, they had some like small group. It looked like less than a hundred people outside complaining, but it's cold. It's cold as shit up here. So that helps when they bust in the antifa guys they forgot to get sweaters or The lower half of their faces warm and everything else is freezing They put they put a bunch of piles of bricks around but they didn't bother to put any sweaters around
Starting point is 00:12:15 Yeah, I guess yeah, were you worried ever watching the case as it was taking longer and longer? Yeah, yeah, I was worried I did not think like I was in denial that they could possibly come to a guilty verdict because I mean, it's the, Sean, you had the right approach, right? Like you didn't need to watch any coverage and you go, oh, yeah. Of course, that guy wasn't guilty because that's the reason. Yeah. Well, like, I honestly don't, I don't even have all the facts straight, like the timeline of things and everything.
Starting point is 00:12:47 Yeah. Like, I really have almost no opinion. I would think that, I would think that they must not have proven the case beyond a reasonable doubt or charged him with the wrong things or whatever, but it seems like, you know, one of the guys pointed a gun at him first, violent pedophile. I mean, a serial pedophile was that guy? Yes. Joe Joe.
Starting point is 00:13:09 I don't know anything about that. He's got a ton of convictions of violent pedophilia. Look, you can probably say, well, I mean, maybe it was a bad idea to just be there in the first place, but that doesn't mean that you're, I'm just leaning. You know, yeah. So yeah, I don't know. I'll go, maybe I'll go back and read everything and all that kind of stuff for whatever reason. I mean, probably sound shitty to say, but I just, I haven't taken that much interest in the case.
Starting point is 00:13:37 And I know I'm, it's healthy. Like, yeah, I'm trying to constantly say to young, to people in the 20s and 30s, like, look, do everything you can do to escape this hell that we live in. Yeah. Put all your energy to that. I got a lot of other things going on. I got a lot of other things going on. Political movements.
Starting point is 00:13:52 Because they, I think I'm, I think I'm, Eric, they'll suck you dry. I think that's great advice. Anyway, Nick, what were you, you were saying about the verdict? You were in denial. I just didn't think that they would possibly find him guilty, but I was really worried about a hung jury resulting in a mistrial and they'd be able to drag this kid through the fucking dirt for another year, two years. I mean, that's one hard thing in these cases is to remember that, you know, just it was
Starting point is 00:14:18 just over a year ago, it was August 25th when this happened. And he's been under the thumb of government for that long. And he's 18. So it's like that's a prime year of development, of activity, of fucking around before like you really find out, you know, all of that stuff. And it's just taken away from him. And that's the shit that pisses me off about it because they knew, they knew that they didn't have to. They knew his bullshit. Yeah. Yeah. I feel that way too. I felt like watching it, the prosecution's entire purpose was just to inflame media attention,
Starting point is 00:14:56 like just to say things that would, I mean, the things they were saying were just like right down the party line of, of outrage topics on the left. Like, do you play violent video games? Is that something you do? Oh my God. That, yeah. You know, and I think that was the interesting thing. I was very critical of both prosecution and defense on this. And it was amazing to see that each side kept trying to lose.
Starting point is 00:15:22 Yeah. Wow. Not that too. Like, what are you doing? Put them on the stand. Yeah. Not that deal. What are you doing? Put them on the stand. He's a fucking kid. No, Steve, and Avery didn't even take the stand. What are you doing? It was that, and then that, that call a duty line.
Starting point is 00:15:37 I mean, if any of the jury, the jurors had a kid or a nephew or, you know know, had ever met a video game. A part of the news, a teenager. Right. Like they're going to be like, okay, that's weird because I know people who play Call of Duty and they don't shoot people. Yeah. Right? Like that doesn't make any sense.
Starting point is 00:15:56 How is as a lawyer, what was your opinion on the prosecution flagging the jury with an AR 15 to close out there. Our fucking guy brings an AR-15 into court and points it at the jury. Like this is what I was like, it was beautiful. Not only any AR-15, that's a haunted AR-15. That thing's got two bodies under its belt already. You never know what it's going to do. Yeah, that was a bit of a bungle. Yeah.
Starting point is 00:16:27 I was thinking, go ahead. And how many people who maybe haven't followed the case that closely, it was based on, you know, the whole riots and everything was because of a police shooting, correct? Proud of me. I don't know. Yeah, it was a white officer shot a black man. Do you think there's a significant percentage that thinks that any of the people that
Starting point is 00:16:48 written how shot were black? Yes, because the news says it all the time. Well, I mean, they don't, they say they don't talk about the race. Some have said shot black people and we're like, are we messing up? I've seen a couple screenshots of newspapers doing it. I think it was a guardian just the other day. The guardian posted that he shot three black men. And then they retracted it, you know, they retracted it quickly, but Google Cash caught it. And yeah, no, they shot three white people. That's the only thing that I've read was like
Starting point is 00:17:21 written house blah blah, you know, age whatever is white. As are the three people he shot. Yeah. Well, he was, he was such a white supremacist. He wouldn't waste bullets on black people. That's, that's the real, that's beneath it. He was, right. He wants them to continue suffering. I saw, I saw something, somebody in the New York post, I think, writing about you or,
Starting point is 00:17:41 I don't know, one of the big papers, but they wouldn't mention your name. Nick, they said a YouTuber, a YouTuber who had over a million views. And it said you referred to the prosecutor with a nasty name based on his physical appearance. What did you, I don't, I used a lot of them actually. What made the papers? Which one? Which prosecutor? It's got to be Krauss, the fat guy.
Starting point is 00:18:08 I assume. He's one of his physical appearance constantly. Yeah. Cause he, I mean, and before he even opened his mouth, the first time you see this guy, he's sitting down in the chair and he's got this fucking title wave of his suit coat coming up and attacking the back of his head. Can fact guys not wear suits? I've seen back guys and suits they look fine.
Starting point is 00:18:29 But you're going to get a suit fine. You're right. Correct. I mean, that's the thing. Jesus. Can't buy off the rack when you're, you know, when you're 600 pounds. Yeah. Yeah.
Starting point is 00:18:39 You got to do it before you hit the, you're, you got to get measured after you go to the golden corral not before. Exactly. I liked when the guy who got his arms shot off went on Good Morning America the next day
Starting point is 00:19:00 to like correct his testimony in the, I assume that in the hopes that the jurors were watching at home. Like they immediately he fucked up because he said, yeah, he shot me because I drew my gun and pointed at him. That's why I read that too. Like I was like, yeah, I understand. Yeah, it says, you know, admits pointing gun at. So we got to get this guy on the news and get him to retestify as quickly as possible. Like how fucking transparent.
Starting point is 00:19:24 There's that, but the other problem that he's got is that he, he, he fucking nuked his civil cases because he has a two civil cases out one in Wisconsin state court and one in federal court against the city and police for failure to protect. Come on, boy, which was already just a bungalow of a case. But when they put them on the stand, Corey Scherafese, the Agent 47 people call him, or Jeff Bezos, whichever, he, he's cross-examining him and he's asking him about these lawsuits. He's like, you reviewed and signed these lawsuits, right? And he's like, yeah. And he's like, so what's in there is truthful, right? Yeah. Well, then why didn't you mention that you brought a gun in your loss? And he's, oh, hold on, let me get on good morning.
Starting point is 00:20:10 I didn't use mine. It's, it was, it was ridiculous. So his, like his civil, like his civil lawyer probably was just drinking pills in the stands while he was saying that because what a he's created. Well, there goes, there goes. They're getting we had an easy settlement. They didn't practice at all with this guy.
Starting point is 00:20:32 Walk him through the answers. He's a guy who strikes me as thinking he's really smart and slick. Probably because he spent a lot of time, you know, visiting a college and talking to people with profundity before going out and protesting and chanting makes intelligence. So this guy's off the charts. And so he sits down. I can imagine they prepped him pretty well, but he just didn't take anything. You could see it, man, he was so fucking cocky while he's talking.
Starting point is 00:21:02 I think it just went, he's like, I got this in the bag. I need to put this kid in the ground. He got these idiots. You'd think getting shot by a kid would take a little bit of the starch out of you. But I guess not. But everybody's been fluffing him as a hero for the past year. Oh, he's the hero who tried to stop the vicious active shooter. The one who was running towards the police, not firing at anybody until a bunch of retards came up and tried to kill him. Did he get hit with something who written house?
Starting point is 00:21:31 Yeah, did somebody hit him with something? No, skateboard. Yeah. Is that, you got, that's true. He got hit in the back of the head with, we don't know if there's anything in the guy's hand, but he did get hit in the back of the head. Then he deflected a skateboard with one arm as it was going for his head. And then he fell and a guy jumped kicked him in the face while he was down on the ground. And then he got hit by the skateboard in the head after that. So I mean, he got hit several times with it. And this all happens in like five seconds. Now, why did they go, why did, why did they go after him? Because he was a. He didn't know why I don't know with a gun or something.
Starting point is 00:22:10 Like, I mean, why did he shot the, yeah, shot the first guy, right? The, the, the peto chased him down. Yeah. And again, Mark Ruffalo's out there calling Joseph Rosenbaum Jojo, like, like the affectionate title. This guy, anally raped five boys, right? Like that we know of. Really? Yes. That's he was convicted for. Worst scumbag on the planet. And Mark Ruffalo's fucking the Avenger is out there going all

So anyway, he's the maniac who instigates this whole thing and you'll still see, you still see a bunch of people saying that because because Binger argued that Kyle Rittenhouse was the aggressor, that that made him the aggressor, which is obvious bullshit. There's no evidence that he ever raised a gun or anything like that. And what they try and do is that this is the deception. And this should actually be rooted out of the criminal justice system. They do frame-by-frame video analysis and act as if a person's making to say,
Starting point is 00:23:29 so they're like, look, and this frame is guns pointed down, but in this frame, it's up. And then in this frame, it's down. It's like, oh, oh, so in a 30th of a second, he raised his gun and that was considered aiming in a 30th of a second. That happened. Okay, thank you. Yeah. So they get that shitty video where they claim he raised his gun and there's all sorts of problems with it. But Sir Rosenbaum chases him and when he ises that dude, then the mob is like, hey, he just shot him. He just shot him.
Starting point is 00:23:56 Get that boy. That's why people start chasing him. Yeah. God, he lucked out. Red house lucked out. He could very easily be dead with that. I mean, if that guy could shoot a gun instead of pulling his Joker piece out of his pocket, like he's pulling out the biggest cock in the world.
Starting point is 00:24:15 If he'd just popped him, that would be done. If he'd have missed, it'd have been done. Unbelieveable, the mob didn't kill him after that. Yeah, I don't know. I was really worried that he'd be sent to jail forever too, just because people are so fucking stupid. Yeah, I mean, it was certainly possible in the way that the prosecution was bringing in bullshit, the defense was not properly objecting to.
Starting point is 00:24:40 And then the judge, you know, this is, we got to see firsthand. I've been screaming it since the Amazon versus Parler lawsuit, but you got these 80 year old judges and they're ruling on issues that involve a critical aspect of technology. Like this judge is sitting there like, wait, so when you, if they're arguing pinch to zoom on a apple doesn't add pixels. It's like a pinch to zoom on any screen necessarily adds pixels. The question is, how does it add them? And if your expert can't tell you,
Starting point is 00:25:11 then you shouldn't have them as an expert. At the end of the day, the judge is like, well, I pinch to zoom, so I guess it's gonna be okay. But he didn't, you can tell he was uncomfortable with it, but this boomer judge allows that in, which allows the provocation argument, which should never have been part of the question. The only person to testify that Kyle Rittenhouse raised his gun is a detective who zoomed in on his iPhone on a video, something that we can't replicate.
Starting point is 00:25:40 You can't verify that he ever saw it. It's complete bullshit. And it's like, that's it. No one on the ground testified that. They could have called the Joshua Zominski to testify. The Kyle raises gun. Would not go after his fifth amendment or he would not be infringing on his fifth amendment right to remain silent in that case.
Starting point is 00:25:59 He could just say, yeah, the guy pointed a gun at me. It was crazy. And they didn't do it because he didn't, he didn't raise his gun. And so I would listen to a lot of talk radio to keep myself occupied. I listened to a lot of Glenn Beck back then. It was like, oh, I never expected to ever be on the show. Yeah. So that was kind of surreal. But other than that, I don't have anything scheduled. I don't know Alex Jones. Incorrect. I'm going to be on Eric July show like today. Young Ripper. Yeah. Starting point is 00:28:43 Cause that got shared by Pesobic and then a bunch of other people. I saw that. Does he have, does that kid, can that kid now sue everybody? Like a sandal man did for defamation? His prospects of winning, it's hard to know like there's been so much said about him by the media and so much of it is wrong. But so I don't know what specific statements would actually be actionable. They're probably our sum, but it's a really difficult case, but he may want to do it anyway because honestly, like if he goes on a, on a, to a crusade against the liars and, and does this big thing, he could raise a lot of money.
Starting point is 00:29:23 He could endear himself to a bunch of people in the way Sandman did. And even if he doesn't win the cases, he'll win in setting himself up for future. And it's hard to argue anything other than people have been consciously lying about. Fuck a professor just wrote up a piece about self defense and got basic facts wrong. This whole he brought a gun across state lines is. Oh my god. The state line thing is killing me. They will people will believe anything as though it matters.
Starting point is 00:29:57 Yeah. Yeah, state like this podcast is coming to you across state like what are you? What are you talking about? Well, because yeah yeah, because, like, do you actually care that he crossed state lines? Why do you keep saying it? Yeah, I don't know.
Starting point is 00:30:10 They keep saying it. But it seems like something, yeah, it seems like something, right. But did they care? Like, they're like, oh, it's a crime. It's a girl, like, give it to you. I don't care that he crossed state lines. Why do you keep pretending that you do?
Starting point is 00:30:22 Because I think they think they got you on a technicality that doesn't exist in this case. The worst kind. Yeah, well, what they don't under, what people don't seem to understand, and this is largely due in fault to the major media and how they'll bring on a criminal law professor who will mention this aspect of law, where if you're engaged in unlawful activity, you can forfeit the right to self-defense.
Starting point is 00:30:48 But you can, it doesn't mean you automatically do. Certainly. Certainly carrying a gun across state lines, even if he had done it would not have invalidated a self-defense claim. In fact, if he was a felon, like if he was Joseph Rosenbaum, not allowed to have a gun. And he broke into a house and stole it. He can only have a gun. Yeah, you know, fully automatic assault kids.
Starting point is 00:31:14 He breaks into Alton kids, fully automatic assaulted kids. He steals a gun and then he's somewhere else. And so he's illegally carrying a gun that's stolen and he's somewhere else and unrelated to that theft, someone comes up and attacks him. Like, I don't know where. He gets jumped and he uses that gun in self-defense. Guess what? That's justifiable self-defense and he doesn't lose it even though he's committing several
Starting point is 00:31:37 illegal acts which allowed him to defend himself. Now he can be convicted on all of those, but shockingly, there wasn't a carry a gun across state lines charge. And if there was, they didn't charge it because he'd never actually did carry it across state lines until he brought it back with them to Antioch to turn himself in. Yeah. Yeah. If they could, if they could have charged, if they thought they could get a conviction or even charge them with it, they would have. People just want blood. Like they just want to dial this up for it. It's really, it's really horrible to see.
Starting point is 00:32:10 Sure. Well, if that was a black guy, you know, they're, you could imagine what would happen. So we got to say the same, same defense. Yeah. But these weird short ass white people kept attacking me. I don't know. I guess if any black male teens are involved in any gun violence someday, maybe we'll see what happens then.
Starting point is 00:32:31 What kind of a strike? If that is. Yeah. Susen Fiery. You know, on the same day as Kyle, there was another major acquittal, and this guy shot a cop, I believe, Daniel Koffee is, I don't, I'm not, I've been so wrapped up in Kyle's case. I haven't seen the, uh, what are you going to do now? Are you going to wait for the next kid to get to,
Starting point is 00:32:57 start gun, gunning people now? What kind of, what kind of velocity are you hoping for next, Nick? Well, what I've done is I've, my large amount of super chat earnings and I've actually started a program to buy AR-15s for 17 year olds just to try and, you know, create more cases. Yeah. No more guns less dads holidays are coming. It's cool. Yeah.
Starting point is 00:33:19 Well, I've been wanting to do a daytime show for a long time to add it to the rotation. And so with a ton of interest that's been generated and a ton of fresh eyes on the channel and on legal subjects, starting on Wednesday, because I get back from Temple on Tuesday. So starting on Wednesday, I'm going to be starting a daytime show. And I don't know the time just yet, but it'll be open invite to the lawyers who join me on the panel. And I'll be inviting other lawyers on. And we're going to just start tackling, you know, legal subjects that are out there. There's a million cases every day. And when a big trial comes up, you know, we'll have a place already established where
Starting point is 00:34:02 people can, can come and get coverage for it. And so I find a real media empire. I know. I know. All from all because he started listening to the biggest problem in the universe, John. Maddox has had some amazing legal takes during this trial. I don't know if you caught any of them. I've seen a couple that you've posted.
Starting point is 00:34:20 They're, they're so fucking phenomenal. It is important to remember that we're just passed the four-year anniversary of the lawsuit being filed. We are four years ago. That's incredible. It's been that long. Talked into doing, reviewing the lawsuit by Facebook, right? No, I was sitting on my couch watching TV and someone said, have you seen this? This is crazy. And so I looked And well, someone said, have you seen this? This is crazy. And so I looked, and because of stereos,
Starting point is 00:34:46 I think, had posted the first copy on Twitter of the suit. And so I started reading it, and I was like, this is just so fucking stupid, that I have to talk about it. So that was, you know, no one,
Starting point is 00:34:59 I don't know if anybody asked me to talk about it specifically or do a video, but I was like, I'm gonna drink whiskey and read this lawsuit. Because it's a laugh. Yeah. And then I uploaded it to YouTube because I was too stupid to figure out how to upload a Facebook video that was, you know, that long.
Starting point is 00:35:14 And that's what started it for me. It's amazing. Four years. You are the hardest working streamer I've ever seen, I think. I can't believe that you obviously so many hours. Next to hours a day. I think video games. I'm like, man, I'm exhausted. And he wants to start a daytime show. It's just so I'm really a piece of shit. You know, it's so much harder for me to, to, to disguise who I am in public that it takes me a lot of energy to stream for even two,
Starting point is 00:35:43 three hours. I think that's the problem. Right. Well, you're a big bitch by 730. Yeah. Um, what do you think's going on with the Gisling Maxwell trial? So you won't get to see her making her testimony with a dude in a black suit with a 45 to the back of her head the whole time, right?
Starting point is 00:36:32 Like, don't say the fucking name, don't say that name. Don't you get anywhere close to clear and I'm pulling this trigger, you bitch. Like that, we won't get to see it and that pisses me off. If they do televised it somehow, I will be covering it, but it's going to be a six-week-long trial. And we're going to get all of it through the filter of the media. Contaminated.
Starting point is 00:36:56 We sell lies. Yeah, and even if it's not lies, like they can't record it. So they have to sit there with a notepad and jot everything down. Starting point is 00:37:29 And it's, it was exemplified over this past three weeks. And it's fucking prosecutors. I hate them. Luke hashtag not all prosecutors, obviously. But the amount of power that they hold, the amount of control that they have over someone's life. I mean, we're talking about Kyle Rittenhouse, but a case I've been talking about now for two years as this case of the kid named Lucas Gerhard.
Starting point is 00:37:56 He posted a picture of his AR-15 on Snapchat to his friends, and some fat fucking bitch that he blocked took that picture that she saw on someone else's phone took a picture of it went to the police and said he's threatening to murder everybody at our college. He has been under prosecution for two fucking years for a Snapchat post and no post no no like verbal posts, you know, the whole post was taking this bad boy up to watch the snowflakes melt and by snowflakes, I mean snow. That's that was his terroristic threat. He's been he was held without he was held without his gun on. Is there not enough crime for these guys? Maybe not.
Starting point is 00:38:45 Real crime. It's a certain kind of crime that gets the coverage. God damn. Dude, he was held without a hearing for 82 days in jail. Are they can do that? Two hundred years old. Yeah. I guess, I guess they did.
Starting point is 00:38:58 So they could. And then he's been on house arrest ever since for over two years now. His dad is a 30 year marine veteran. I think he's like a lieutenant colonel in the marine super nice guy. And this kid, he's just a goofy kid, right? And he's out there. And this all started by the way, because he was asked, you know how they, in college classes now they do this bullshit where they have a fucking forum for your class. And they're like, here's a discussion question, you must post two responses by Friday or you fail the class or whatever. And they asked about should police physical standards be dropped
Starting point is 00:39:37 for female police officers? Yes, yes, yes, yes is the answer. Let me help you out kids. Yeah. And then go live your life. Go move on with your day. Exactly. That's it. Exactly. And but two years ago, he said, no, I think the standard should be the same. You know, and he's like female police officers. He even apologized through it.
Starting point is 00:39:57 He's like female police officers are fine. So long as they can meet the physical requirements and all that stuff. And that they don't drop. But it was, it was not good enough. And then the small group of female students have been after his ass ever since and it's gotten two years of his life just vaporized like a fucking bicep in Kenosha. And that shit pisses me off because it's on the prosecutors. They know it's an exercise of free speech. The prosecutor in that case, at one of his pretrial hearings to try and get his ankle
Starting point is 00:40:29 bracelet off so he could fucking go do anything with his life. He can't use the internet for two years. He can't use the internet. You're stupid. I mean, he may kill someone. Yeah. Yeah. So, so that what the prosecutor did to keep the ankle bracelet on
Starting point is 00:40:45 and the restrictions on this kid is they played the Christ Church shooting in court for the judge. Which he has nothing to do with. Exactly. And it's like, okay, I get that you have a job to do Mr. Prosecutor, Mr. Prosecutor, I don't know what it is, but it's like, but fuck you.
Starting point is 00:41:06 Like that, that's too far. You know, a lot of this, a lot of people in the written house case are watching it. So, avidly, like people were consumed by it. We're using it as, in their own words, we're using it as like a barometer to see how, to see if the court system was fucked or not. And it annoyed me the whole time,
Starting point is 00:41:23 so my guys, don't, like like Kyle getting off does not prove anything. It's fucked. It's so hopelessly fucked. You just happen to know about this one. Please don't be relieved. Please don't consider this as an important win for your side or for justice. It's great that the kid got off,
Starting point is 00:41:42 but do keep thinking. Don't worry, it's fun. Assume that it was fucked. There's some kid exactly like this getting fucked somewhere and there's hundreds of them or thousands even. That one really annoyed me. There was a lot of things about this case. They really annoyed me.
Starting point is 00:41:59 The canonization of Kyle annoyed me too, like this idea that he's, that he was, like he's like a boy scout, like, or he's like the universal soldier or whatever, Captain America. He's just like, no, he's fucked. Like he's, he's definitely, he's fucked that, like, I think Jack probabilistic, so like I'd rather have 50 Kyle's than one. It's like, I don't want any Kyle's anywhere near me. Keep them away. I don't want any, I don't want any kiles anywhere near me. Keep them away. I don't want
Starting point is 00:42:25 any, I don't want this vigilante shit. Thank God. And this is innocent. This is also what a, what a kid might do. Yeah, this is bad. Doesn't get that it's, this is like real shit. You know, you don't see the consequences coming or the potential outcomes, you know, but it's like, you know, it made me about George Floyd too. Like, oh, no, he was a big gentle giant. No, he's a fucking criminal and a reprobate and a drug know. But it's like, no, it made me about George Floyd too. Like, oh no, he was a big gentle giant. No, he's a fucking criminal and a reprobating, a drug addict. But he's still sitting there, got caught by killed by the cops. Right, right, you weaken your argument, I think,
Starting point is 00:42:53 when you canonize the person who something bad happens to. And you piss everybody off. It doesn't seem like that way. No, it's just, yeah, no, he wasn't a great guy. Doesn't mean that's what he should have gone. Like the Kyle thing, I don't even know. I just merely asked if Kyle was on video saying he wish he had his gun so he could shoot it looters. Yeah. And it was like a fucking torrent of people going, what are you even,
Starting point is 00:43:13 what are you talking about? That doesn't make my bro. I'm just fucking asking if this is him on video. I don't know. I mean, I don't really think it's crazy to want to kill criminals. I thought that was something we all wanted to legally do. People think that all the time. Yeah. What are we doing when we're watching movies? Like when I'm watching Die Hard, and he says, that's what my captain keeps telling me
Starting point is 00:43:35 about criminals having rights. I'm going, yeah, fucking awesome. Fuck those, like, we all think this way. We're all a bunch of murders and psychopaths in this country is why we have to law. I don't know why you think about that, Nick, but it just annoyed me subtly the whole time. Well, I think it's a really unfair characterization of Kyle and it's not helpful, right? I don't know if I go as far as you in the vigilante language, because what it looked like to me was this kid who was like,
Starting point is 00:44:06 I'll go help my community. I'll bring my gun because it could be dangerous, but I think having this thing here is going to, it'll tell everybody, just to, I'm not here to mess around. We don't have any evidence that he was actually pointing his gun at anybody any time to the night, threatening anyone. You find out, like, through most of the evening, whenever he's at a confrontation, he just kind of tries to make a snarky, not very funny remark because he's 17, 17 year olds aren't funny.
Starting point is 00:44:34 And he's like, oh yeah, I pointed my gun at you and then he walks away. He's trying to diffuse and disengage the whole time. And even when he's like, he gets to that place, they set up, it kind of looks like an ambush. I don't know if they're intentionally doing it, but it's certainly what they totally are because that's exactly the same thing they did to me, trying to walk me down an alley away from all the people with that stupid embrace that they do, where they loop their arms around you. Look, when you have a group of people kind of coming at you and you're retreating, you have to feel
Starting point is 00:45:07 that that's somehow that's a dangerous situation that could get worse. I mean, that's just, that's in our DNA. You get ganged up on, you're trying to leave the situation, they're following you, they're bringing the true, you're stepping away from trouble, it's following. I mean, you've got to, that has to get your adrenaline up. Yeah.
Starting point is 00:45:30 It's every, it's every movie, right? Like every action movie that takes place on a street and there's like one person following the guy and he's like, kind of, he's like, okay, and then suddenly like a couple more join in. They're following turns of corner. There's a group of people walking at him and you're like, oh, fuck, okay, it's how they build tension in movies.
Starting point is 00:45:47 Because that's what that's the quintessential human fear is that you're going to be alone and there's going to be a whole mob of people and you just won't have anywhere to go. Right. And so that's why it was always looked like self-defense to me. But again, he looked like a kid who had a lot of naivety about her was going on that night. And that's what made it so dangerous. That's why I've said over and over, I would never want one of my kid, my kid's 14, my oldest. And it's like, in three years, no, I would never want them at a protest at all because of how, how shit can go south so quickly.
Starting point is 00:46:23 He's a kid. Yeah, and the way he actually, the way he went around shouting medic was what made me think, oh, he's got something, there's something wrong with that thinking. Like he wants to be, like some kind of weird savior. Do you see that he was doing that going around going like medic? And he wouldn't need a medic? It's like he's not a medic.
Starting point is 00:46:41 He was like, he's not medical training. Well, I thought he, like trained and trained to support. That he was training as an EMT or something, but's no medical training. Well, I thought he, I thought he like trained and trained his support. I thought he was training as an EMT or something, but I don't know. Yeah, maybe very uncomfortable. Yeah, yeah. I guess I,
Starting point is 00:46:51 I know he's not a medic. Yeah, that's, but he wanted to be a fireman. He wanted to be an EMT or he wanted to be a cop. And I mean, you saw all three elements there, right? All the way to shooting people. Sure. So, but one,
Starting point is 00:47:04 one of the shot-to-write people. So, but one of the short things. Yeah, exactly. It's true. One of the good things about having such a large audience for the streams though was it was exactly what you were talking about. And several times I was able to say, guys, this is a fucked up situation. But if you think this is limited to Kyle Rittenhouse, no. Kids getting charged for gun crimes, get the same railroad treatment. People getting charged with domestic violence, get the same railroad treatment.
Starting point is 00:47:33 Our system is supposed to be deferential to the defendant and it is overwhelmingly deferential to the state. Yeah. Do we have a higher end? Do we have a higher end? Do we have a higher end? Do we have a higher end? Do we have a Yeah. Don't we have a higher prosecution success rate than like China? It's like 99% success for prosecutors. Something ungodly.
Starting point is 00:47:50 It was something like 95 or 96. It's something, yeah, when it's like the state. It's huge because of plea agreements, right? Oh, right. And there's another case, and the media is touting this as unfair, but there's another case in Kenosha, I think, or in Wisconsin, where a woman was allegedly raped by a guy. She grabbed his gun and ran away from him, and then he confronted her as she was getting into a car later.
Starting point is 00:48:18 And she shot him through the window and he died. And she's going to prison for six and a half years, but it's because she took a plea deal. She took a plea deal because the prosecutor, the prosecutor made a motion that she wouldn't be able to raise the self-defense claim in court. Now, I don't know if he actually won that motion, but the reality is, with the state leverages this against you and says, oh, by the way, you shot this guy. If we win, you have a mandatory sentence of 30 years to life. And then, and we're gonna, oh, we're gonna take away
Starting point is 00:48:50 your opportunity to even raise a self-defense claim. Or, you know what, you can, you can plea down six years, you'll be out, you can rebuild your life after that. And someone goes, the rest of my life forever, or six years. Yeah. I don't trust the system, I guess life forever or six years. Yeah. I don't trust the system, I guess I'll take six years.
Starting point is 00:49:07 Yeah. Yeah. And all the people, all the smart people are bragging about how easy it is to get out of jury duty. I love that one. Oh, what the fuck is wrong with this jury? Like, yeah, you guys have spent the last couple years explaining how easy it is for you and anyone smart to get out of doing jury duty.
Starting point is 00:49:23 Now do you think, do you see? Now what the effect of that is? Yeah. I mean, I would do it too, but it's easy to get out of jury duty. Just say, yeah, I think he's guilty. Like just say that. It's like people who carry guns or assholes, there you go. You're out.
Starting point is 00:49:43 You're out. You're out of jury duty for that crime. Like that's the people who figured it out, it doesn't take all that much thinking. But the real problem is that if you're actually an objective person and you're trying to just get out of jury duty, that's like a disservice to the defendant. A horrendous disservice to the defendant because it, you know, that means that someone who's either too retarded to get out of it or his bias is going to stay in. And that was a big complaint a lot of people have. It's like the people who are admitting that they couldn't be objective in the case.
Starting point is 00:50:19 Like that was probably supporters of Kyle Rittenhouse. Oh, man, I'm really thinking about this hard. I can't be objective. because if you're against him, right, you're like, oh, I can't be objective. But why would I say anything? I want this kind of, of course. Yeah. That is a right wing problem for sure. Well, at least we're, you know, you have to be honest. Like what the fuck is wrong with you? No, you don't have to be. No, I pick a few things. But in a case like this, it's hard to get a, it would be hard to get like an, somebody who's unaffected at all, right? Because everybody has an opinion, you know, as a kid, your flammatory articles, it's like
Starting point is 00:50:55 everything's sensationalized. So it's like, how do you, how do you get a, you know, how do you get a jury that's more or less unbiased? You know, part of my, go ahead, Nick. We saw it in the show in case, right? The guy who went to a Black Lives Matter, traveled from Minnesota to Washington, D.C. to go to a Black Lives Matter march wore a shirt that said, don't kneel on our necks and listen to George Floyd's brother and sister give speeches sat there and told the court that he didn't participate in any Black Lives Matter events like or any or it was even more general. It was, did you participate in any marches or demonstrations that dealt
Starting point is 00:51:37 with police violence? Any fucking, he just lied. He said no, because of course he did. Of course he would lie about that. And so yes, the rights all like, oh, I've got to be pure in my approach to the jury. And I would never suggest anyone lie. But the question is, can you remove all of your biases? Can you be impartial? The answer everyone should have is no. Like no one can do that.
Starting point is 00:52:03 And that's the distinction between that guy is he goes, I can do it enough. And someone on the right goes, no, I can't do it at all. It's not possible. It's like, no, you can do it just as well as the next guy. You really can. Don't make it easy for him. You know? I think I did one is the part of the reason that I am less inclined to be charitable to Kyle is that I think somewhere along
Starting point is 00:52:25 the way, the idea that you can be, that you can be innocent and also a bad person is lost. Like the idea that you have to be good to have rights does not exist for a lot of people, I think. Like the way, like you can see it on the left, it's obvious. Like, oh, it's white supremacist. He brought a gun to cause trouble. Therefore guilty. Like, no, no, everything that you're saying can be true, he can be a white supremacist.
Starting point is 00:52:50 He can be a white supremacist. He could have gone there to start trouble. Doesn't mean he violated the law. He violated the law. Right. That's right. George Zimmerman wants to know your location right now. He's like, oh, this is my kind of guy, right?
Starting point is 00:53:01 Yes. That's what I mean. I had with Maddox back on the show was, yeah, he killed that. I mean, it's sucks, but he's not guilty. Yeah, and it's like he, he's like, but he's such an asshole and blah, blah, blah. It's like, well, maybe, maybe he is an asshole. Again, no one gets, has to sit there and have their head pounded into the fucking pavement.

And they're sitting there talking and like as you guys need guns for self defense more than anybody. That's what you're doing. Yeah. Exactly. Exactly. Because the right of self defense is a, how do we, how do we call it? Fucking it's tied to virtue or it's tied to what is how aggressive it's a regressive. Yeah. I've had some incredibly taxing emotional moments myself to the whole family court thing. It's not just the money, time, and energy. It's the fact that your authority and agency over your own life is taken from you.
