Starting point is 00:00:00 All right, folks, so it is two in the morning at the time of me filming this. Yes, I am awake, but I am happy to announce, proud to announce that we just won. Democracy won, America won this morning, because a federal judge has ordered Donald Trump in the White House to immediately, immediately right now, restore the press passes for Politico, for CNN, for MS now, these different media organizations that Trump kicked out of the White House, this federal judge in the middle of the night saying, actually, you got to bring them back, saying that Donald Trump's ban punished routine reporting and the White House provided zero evidence for its national security claims.

Starting point is 00:00:36 Here's what the judge wrote. The court is skeptical, at least on this record, that defendant's interest in safeguarding national security is the actual motivation for or is even advanced by the revocation of plaintiff's hard passes. Even this judge appointed by Donald Trump is saying, you're full of crap. You're not revoking their press passes because you're concerned about. national security, you're revoking it because it's retribution, because Politico, MS now, CNN, have reported on things that Donald Trump did not want them to report on. That is it. That's why

Starting point is 00:01:09 Donald Trump did it. Even this Trump-appointed judge is saying that. Here's more from Kyle Cheney, citing the urgent need of a free press. Judge Kelly's restraining order brushed off the administration's national security claims as after the fact justification for a ban that Trump imposed over disagreements with the outlets reporting. Kelly's ruling ensures that the three outlets can resume their White House access, so that they mean, that means they go right back into the White House, whether Donald Trump likes it or not, just in time for Chinese President Xi Jinping's state dinner, which the Justice Department cited somewhat bizarrely today as a reason to maintain the ban, which almost seems counterintuitive.

Starting point is 00:01:45 Like, isn't a state dinner meant to be public? Like, the American people are meant to see that. And Donald Trump is citing that as a reason for the press not to be there. It's just a really stupid argument, and the judge did the right thing. Now, I will say that this is a temporary restraining order. This is not permanent. There's a lot of things that still need to be worked out in court, but this Trump-appointed judge in this order said that the plaintiffs are likely to succeed,

Starting point is 00:02:09 that CNN, MS now in Politico are likely to succeed, and that Donald Trump and his DOJ are likely to fail. I'm up at 2 a.m. doing this because I think it's important. And let's get into it. So, Judge restores the White House access. And here's more quotes from the judge.

Starting point is 00:02:31 Early Thursday, U.S. District Judge Timothy Kelly granted this temporary restraining order sought by all these different media companies as part of this joint lawsuit, setting the urgent need of a free press. The Trump appointed judge suggested that the national security grounds, the administration claimed to justify the ban, amounted to an after-the-fact justification of a decision. The president appeared to have made over more mundane disagreements with their reporting. as we said, or I should say, as we read, the court is skeptical, at least on the record, that the interest is in safeguarding as opposed to just having disagreements. Nothing in the record that predates this suit suggests that the revocation of plaintiff's hard passes was motivated by national security concerns.

Starting point is 00:03:10 Certainly, that is not what Donald Trump said when he announced that he was banning them from the White House. Instead, he focused on the alleged lack of truthfulness and negativity of their reporting. So Donald Trump's own words, kind of contradicting the argument that the White House went with, which is just such a funny turn of event. It's so funny how Donald Trump's own words constantly shoot himself in the foot. They shoot Republicans in the foot all of the time. You know, for example, all of the Republicans say that Zoran Mamdani is the scary communist who's going to ruin America and things like that.

Starting point is 00:03:41 And then you have Donald Trump who's kind of like, well, you know, I think Mom Dani's been a great mayor so far. He's off to a great start. Kind of, you know, ruins their arguments. The judge noted that the administration provided no support for its assertion that any of the disputed stories that they cited in their response, contained classified information or actually damaged. Starting point is 00:04:29 National security and said some of the reporting was months or years old. Belying claims the administration's claim of urgency by the administration. Kelly also said the White House appeared to have violated the constitutional due process rights of the journalists by failing to give them advanced notice that concerns about their reporting could lead to cancellation of their passes, which is the right move. they just completely randomly did it. It was one day Donald Trump woke up and he was pissed off that he saw some stories in the media and Politico and CNN and whatnot were reporting on and he said, you know what, I'm going to do it.

Starting point is 00:05:04 Matter of fact, we actually know what happened. Natalie Harp showed him a video of people talking about him about him on air and it pissed him off so much that he banned them. It was random. It was arbitrary. There was no due process given. Theodore Butrus. What a name.

Starting point is 00:05:18 Theodore Butrus. I love this. The elite attorney for the news organization. welcome Kelly's orders and the speed with which it was issued. Quote, this is a strong ruling vindicating freedom of the press, due process, and the rule of law. We greatly appreciate the court's swift action. The judge's ruling came after a hearing on Wednesday where they argued that it violated the First Amendment. And look, it is two in the morning right now, which means a lot of the Trump supporters and probably Donald Trump himself have not seen this order yet at the time of me filming this.

Starting point is 00:05:47 So I don't know their reactions. I haven't seen it online, but I can imagine what it's going to be. They're going to kick, they're going to scream, they're going to have a temper tantrum. But once again, I have no idea how they thought they were in a strong position to argue this when Trump was posting things like this about the ban. Quote, all the sleaze bags like third-rate reporter Caitlin Collins of fake news CNN, a truly unhappy person, said they weren't going to be covering me. Then why were they ranting and raving like lunatics in the press area at the UN? Why was she there? She's got a Trump addiction and so does CNN and MSDNC.

Starting point is 00:06:18 They're all sick, treasonous and demented. The good news is that they have a great friend. them and totally disloyal judge. So this was before the ruling, Donald Trump kind of expecting the judge to rule against him. But in none of this statement, does it, does Donald Trump make it seem like, oh, he's doing this for national security reasons? In all parts of this statement, he's attacking CNN. He's calling them sleaze bags, treasonous, demented. This is a personal thing for Donald Trump. I mean, it's not like, you know, we really have to explain this to anybody, really. Everybody knows what it really is, that this is Donald Trump enacting revenge on media

Starting point is 00:06:51 companies that he doesn't like, and the idea that it's any, anything to do with national security is ludicrous. But that's the argument they went with, and it's just baffling to me that anybody thought that they were going to succeed.
