Starting point is 00:00:00 All right, folks, we are now on day two of Donald Trump's temper tantrum over his tariffs being declared illegal by the Supreme Court. He's still raging on social media, still obviously furious in public. But what's really getting under Donald Trump's skin is the fact that two justices that he appointed to the court ruled against him. And one of those justices is taking on his fellow MAGA judges in a scathing way. He's coming after Trump. He's coming after the other MAGA lunatics on the court. it is a civil war taking place on the maga side of the Supreme Court. So I want to break it down for you.
Starting point is 00:00:34 We'll talk about it a little bit. Read some quotes from what they had to say. So this is what Donald Trump said yesterday about the justices who ruled against him that he appointed. That being Amy Coney-Barrant and Neil Gorsuch. Gorsuch was appointed in 2017.
Starting point is 00:00:57 Amy Coney Barrett was, of course, appointed after Ruth Bader Ginsburg died in 2020. And here's what he had to say about them after they ruled against him. At the same place, yeah, please. Justice is Fortinette and Barrett, are you surprised in particular by their decision today? And do you regret nominating them? I don't want to say whether or not a regret. I think their decision was terrible. I think it's an embarrassment to their families.
Starting point is 00:01:25 You want to know the truth, the two of them. Yeah. An embarrassment to their families that they ruled correctly, that they just didn't give Donald Trump unlimited power to put any amount of tariffs on any country that he wants to. That's an embarrassment to their family, according to Donald Trump. And that's just his view, I guess. As I mentioned, we're on day two, though, of his temper tantrum, his meltdown, because earlier today, he announced that he's raising the global tariffs he announced yesterday from 10% to 15%.
Starting point is 00:01:56 He said based on a thorough, detailed, and complete review of the ridiculous, poorly written, an extraordinarily anti-American decision on tariffs issued yesterday, after many months of contemplation by the United States Supreme Court, please let this statement serve to represent that I, as president of the United States, will be effective immediately raising the 10% worldwide tariff, which he announced during this press conference yesterday, on countries, many of which have been ripping the U.S. off for decades, without retribution until I came along to the fully allowed and legally tested 15% level. says based on a thorough, detailed, and complete review of the ridiculous, poorly written
Starting point is 00:02:30 decision from the Supreme Court, he means that Stephen Miller handed him a binder that said, not good. Just two words. He doesn't really like to read above two words. Three is too many for him. So that's his thorough, detailed review. And now, apparently, everything is about to get 15% more expensive, not just 10%. It's now 15%.
Starting point is 00:02:47 So that's what he's doing. He's even revoking endorsements for Republicans who have spoken out against his tariffs. For example, he said earlier today, based on. a lack of support in particular for the unbelievably successful tariffs. He is living in fantasy land imposed on foreign countries and companies, which has made America richer, stronger, bigger, and better than ever. I'm hereby withdrawing my endorsement of Rhino Congressman Jeff Hurd of Colorado's third congressional district. Instead, he's endorsing another candidate who he calls a highly respected patriot. I wasn't joking when I said we're on day two of the temper tantrum. Yesterday,
Starting point is 00:03:20 he's saying it's an embarrassment to people's families that they ruled against him. Now he's revoking endorsements. He is not happy. And it's, I don't think it's going to stop anytime soon. And that brings us to this mini civil war, this MAGA civil war that's taking place on the Supreme Court. And the man behind it is Justice Neil Gorsuch, the first Supreme Court justice that Donald Trump ever appointed and got on the bench. And now he's taking aim at his fellow MAGA judges for their hypocrisy, essentially.
Starting point is 00:03:47 Neil Gorsuch wrote a scathing concurring opinion, calling out his fellow conservative justices following the Supreme Court ruling, striking down Donald Trump's tariffs. The court's decision was made based on the major questions doctrine, which states that a policy of major national significance must be enacted with clear congressional support. Gorsuch criticized the court on Friday for its lack of consistency in its application. Gorsuch, who was appointed by Trump in 2017, was one of six justices to rule against the signature economic policy. Of course, he had the three liberals, John Roberts, and then the two conservatives in addition to Roberts. But Gorsuch asserted that the other justices apply the major questions doctrine differently, depending on who's in charge. You don't say, oh, wow, you know, this is a stunning revelation that we've never heard before.
Starting point is 00:04:36 It's almost like, it's almost like these MAGA judges on the Supreme Court treat the law differently if a Democrat is in office. And they've been doing this the entire time. People like, you know, Thomas and Alito, they just love to say, well, you know, this is okay if Donald Trump does it. but if Joe Biden does it, then it's unconstitutional. Well, what a revelation. For example, it was used to justify striking down Joe Biden's student loan forgiveness plan, a six-three ruling along ideological lines. This time, half of the conservative justices split from the majority opinion to support Trump and his tariffs. Quote, still others who have joined major questions, decisions in the past, dissent from today's application of the doctrine, he said,
Starting point is 00:05:18 referring to dissenting justices Clarence Thomas, Samuel Alito, and Brett Kavanaugh. Of course, we know Thomas and Alito have always been on Trump's side. Brett Kavanaugh has sometimes broken from him, sometimes stayed with him. But of course, he was appointed by Donald Trump and supported by Trump. So his loyalty is there. He also had pointed criticism toward Thomas, who he said, quote, submits that Congress may hand over to the president most of its powers, including the tariff power, without limit. He said, quote, and this is a good one, it is an interesting turn of events. That's right. You know, and, oh, man, I have studied law undergrad in my college career.
Starting point is 00:05:57 And so I was mainly doing that during the Biden years. And I would read these cases. And this is something that Clarence Thomas consistently said that, you know, Congress should not be handing over their powers to President Joe Biden. He's taking too much power. It's being concentrated in the executive. But Donald Trump, when it comes to immigration, when it comes to tariffs, when it comes to presidential power just broadly, Thomas is like, oh, have it all. You, yeah, why not? Just give me a take it, you know, who care? What are we going to do to stop you?
Starting point is 00:06:23 It's so gross. Gorsuch also addressed the liberal justices, Sonia Sotomayor, Elena Kagan, and Katanji Brown Jackson, whom he similarly believes were inconsistent about the doctrine. That is not exactly surprising because they always go after each other. The Republicans, the Democrats, they always go after. Kagan joined by Sotomayor and Jackson wrote a concurring opinion, saying the ruling could be reached without the use of the doctrine, which they have historically been critical of.
Starting point is 00:06:46 Gorsuch noted that they did not object to the doctrine's use. Quote, past critics of the major questions doctrine do not object to its application in this case, and they even join much of today's principal opinion, but they insist they can reach the same results by employing only routine tools of statutory interpretation. Gorsuch opinions spoke to growing fears about the politicization of the court, which despite ideological splits, has typically been regarded as politically insulated, which has just completely evaporated over the past. I mean, I don't know, I guess really much.
Starting point is 00:07:18 Well, actually, I was going to say since Donald Trump got into office, but I'd even go back all the way to the early 2000s, 1990s, is really when things started to go downhill and the politicization of the court really got bad. I mean, Bush v. Gore, for example, I wasn't born then. I don't forget about that one, though. Trump insulted the justices who ruled against him, as we just saw. He called them lapdogs, a disgrace to our nation,
Starting point is 00:07:40 and disloyal to the Constitution. The president also reportedly went on a tirade against the court during a meeting with the nation's governors. Despite the ruling, Trump announced that he's putting the 15% tariffs globally. So Neil Gorsuch really not expected this from him. I really, really didn't. He, like, he's one of those, again, he's one of those justices that sometimes does the right thing and oftentimes doesn't. One of the most surprising rulings I've ever read for him or one of the most surprising concurring opinions I've ever read from him was in a workplace discrimination case where they established the but-for test, meaning would this person be discriminated
Starting point is 00:08:17 against but for their gender. And if it fails the test, it's workplace discrimination. It's gender discrimination. And he actually sided on the right side saying that, yes, of course it is. While the Republicans, many of them said, no, it's not. And so he has an opinion like that. And then he'll simultaneously side with Donald Trump on issues like Roe v. Wade, but then also strike his tariffs down. It's weird. He's a weird justice. And I really wasn't expecting him to turn on his maga buddies on the court. They're all, they all stick together most of the time, but he did. And Donald Trump is not happy about it.
