Starting point is 02:59:40 regard and deference and respect to the opinions of each other. You should consider that it is desirable that the case be decided and that you have been selected in the same manner and from the same source. I think it's his job to repeat this. I do. I know you are.
Starting point is 02:59:56 on another side. There is no reason to suppose that the case will ever be submitted to 12 persons more intelligent, more impartial, or more competent to decide that more or clear evidence will be produced.
Starting point is 03:00:13 And with this in mind, it's your duty to decide the case if you can do it conscientiously. In order to make a decision more attainable, the law imposes the burden of proof on one party or the other, in all cases. In the present case, a criminal case, the burden of proof is on the Commonwealth
Starting point is 03:00:32 to establish every element of the crime charged beyond a reasonable doubt. Tell them, Judge. If you were left in doubt of any element of the crime, the defendant is entitled to the benefit of the doubt and must be acquitted. However, in conferring together, you ought to pay proper respect to each other's opinions and listen with an open mind to each other's arguments, thus where there is disagreement. You get the gist. The rest of this is.

Starting point is 03:02:10 Let me ask you guys, if you were a member of this jury, and this is the Lindsay Clancy trial where she is killed her three kids. Of murdering her three children. If you're in this jury, How do you look at that? I look at it.
Starting point is 03:02:28 I don't know the evidence, so I can't. I would not find her, I mean, I would find her guilty of the charge only because they were saying that she sent the husband out to run errands and did this while he was gone. So you kind of knew something. Like the defense is, it was premeditated. Yeah, the defense is she was like in a psychosis. It was, she wasn't, she didn't know what she was doing, basically.
Starting point is 03:02:52 That was what the defense, it's not, it's not, did she do this? Yeah, the question is whether she did it. She did it. She killed the kid. No, she did it. But it was, it was like she had almost like a psychotic break and didn't really realize what was happening. But once I looked into the case and it's, she had the husband leave. And while he was out running errands, she did this.

And I want to be clear that me talking about the case, I'm talking about the jury and how they came to their selection. And the one person might have heard something there. Like, again, he's even in the judge talking.
Starting point is 03:04:21 he said, yo, you don't always have to have a 100% certainty. But then later on, he said, yo, if there's a reasonable doubt, you got to rule on the, they're too contradictory things. Well, I think those two sound the same to me. A hundred percent certainty is no doubt.
Starting point is 03:04:39 Yeah, he's saying you'll never get that. He's saying you'll never have it. He said you'll never have 100% certainty. Which means that there's a reasonable doubt. No, that's not what that means. Yeah, I didn't take it like that means. So that's the whole point when they say, there's always, his point is,

I've seen them ups, downs, highs, lows, et cetera, et cetera. I know this individual or I think I know this individual based on our past history. And this person is not being who I know them to be. Starting point is 03:05:46 We had a conversation recently about one of our colleagues. And you said that the person. wasn't themselves the last time you saw them. And then other people are going around saying, she's not herself, she's not herself, she's not herself. So that particular person that you've known, well, their whole life, essentially, not being themselves, if they did some shit that was off the rails,
Starting point is 03:06:08 you would be like, yo, dog, they haven't been themselves in quite some time. Unless they kill my kids. Then I'm not going to go. I was just getting right. Then I'm not going to go. I'm going, hey, he's been itself. I'd be way too emotional to even. We're not talking about that part.

You know, now typically in practice, they keep your ass there for 10. 20 years anyway, you know, but they don't necessarily have to. Whereas you get a prison sentence, you get a prison sentence. Yeah, you get a prison sentence.
Starting point is 03:07:28 So, so once the staff feels like, because again, if we blame it on postpartum situations, she might be quote unquote clinically well in four years. And now you get to go home. Whereas if it's a murder charge, first degree murder charge, you might be looking at life.
Starting point is 03:07:43 You might be looking at the L. Got you. That makes sense. And that feels fair to me. If I knew as a matter of fact, we don't know this way. Yeah, I don't know anything about the case. So I don't have an opinion on what's right or what's wrong. But if it turns out to be that she has postpartum psychosis, then yeah, I want to make sure. All right, so what it says, depending on their findings, the jury can reach murder convictions, lesser offenses such as manslaughter or fine clancy not guilty because of lack of criminal responsibility.
Starting point is 03:08:10 Then it says, you know, first degree murder means life imprisonment without parole. Second degree murder is life with parole. With possibility of parole, manslaughter is a maximum 20-year sentence. and an insanity slash lack of responsibility verdict does not necessarily mean she simply leaves a courthouse. Massachusetts has procedures that can result in psychiatric commitment if she's determined to pose a danger. So that still...
Starting point is 03:08:35 She could potentially go home. Yes. Technically, but the argument is you do pose a danger because you just killed three kids. You just kill somebody. And so until you're well, or we deem you being well, go sit up for them in a minute. Right. Because I guarantee you if the state loses, the first thing they do, before they even hit the gavel.
Starting point is 03:08:54 Put her 10 years in the home. Are they going to, um, if, so the judge is ordering them back. Is this to our reconvenile? I saw something else that said that that's been rejected and this has been declared a mistrial, so I don't know.
